Özet

Bu araştırmada Türkiye'de suça sürüklenen çocuklar konusunda hukuk alanında yazılan tezlerden yola çıkarak araştırma eğilimleri ve boşluklarını tespit etmektir. Bu maksatla araştırmalarda ele alınan konular sorunlar öneriler ve konuya ilişkin yaklaşım farklılıkları belirlemek amaçlanmıştır. Bu amaçla konunun hangi yılda çalışılmaya başlandığı, hangi yıllarda araştırmanın yoğunlaştığı, kullanılan anahtar kelimeler, konular, sorunlar ve sunulan öneriler tespit edilecektir. Yükseköğretim Kurulu'na ait https://tez.yok.gov.tr/UlusalTezMerkezi/ adresinde bulunan arama motoruna belirlenen anahtar kelimeler yazılmış ve filtrelerden elde edilen tezlerden mükerrer olanlar çıkarıldıktan sonra 23 tezin buğuları incelenmiştir. Çalışma sonuçlarına göre ilk yazılan tezin 1985 yılında yazıldığı, doktora düzeyinde bir çalışma yapılmadığı, tezlerde ele alınan konulardan çoğunluğunun muhakeme süreçleri olduğu, tezlerde en sık yer alan sorunun çocuk ve yetişkinlerin aynı hukuki düzenlemelere tabi olması sorunu olduğu ve buna karşılık en sık yapılan önerinin de çocukların yetişkinlerle aynı düzenlemelere tabi olmaması, çocuklara özgü ceza muhakemesi usullerinin geliştirilmesi önerisi olduğu görülmektedir.

This study aims to determine research trends and gaps based on theses written in the field of law on children dragged into crime in Turkey. For this purpose, it is aimed to determine the topics, problems, suggestions and differences in approaches to the subject addressed in the studies. For this purpose, the year in which the subject was started to be studied, the years in which the research was intensified, the keywords used, topics, problems and suggestions presented will be determined. The determined keywords were typed into the search engine located at https://tez.yok.gov.tr/UlusalTezMerkezi/ belonging to the Council of Higher Education and the duplicates obtained from the theses were removed and the results of 23 theses were examined. According to the results of the study, it is seen that the first written thesis was written in 1985, no doctoral study was conducted, the majority of the topics addressed in the theses were trial processes, the most frequent problem in the theses was the issue of children and adults being subject to the same legal regulations and, on the other hand, the most frequent suggestion was that children should not be subject to the same regulations as adults and that criminal procedure procedures specific to children should be developed.
