Özet

Roma, tarihsel süreç içerisinde başlangıçta bir krallık olarak ortaya çıkmış, daha sonra cumhuriyet ve nihayetinde imparatorluk hâline gelmiştir. Bu dönüşüm sürecinde Avrupa, Afrika ve Asya'nın önemli bir bölümünü hâkimiyeti altına almıştır. Roma uygarlığı, hâkimiyeti altındaki topraklarda birçok alanda derin etkiler yaratmış; bu etkiler arasında belki de en kalıcı ve önemli olanı, günümüzde pek çok ülkenin hukuk sisteminde izlerine rastlanan Roma Hukuku olmuştur. Romalılar tarafından şehirlerinin kurucusu olarak kabul edilen Romulus ve onun ardından gelen Numa Pompilius başta olmak üzere, Roma'yı yöneten kralların ortaya koyduğu makam ve kurallar, değişen ihtiyaçlar ve sorunlara yanıt niteliğinde olmuş, cumhuriyet dönemindeki idari ve hukuki sistemin temellerini atmıştır. Krallık döneminde ortaya çıkan bu yapıların neredeyse tamamı dini bir karakter taşıdığından, söz konusu dini etki cumhuriyet döneminde de varlığını sürdürmüştür. Krallık döneminde teşekkül eden Collegium Pontificum, Collegium Augurum ve Collegium Fetialium gibi kurumlar, dini yapının ayrılmaz bir parçası olmanın yanı sıra, Roma'nın idari ve hukuki yapısını da derinden etkilemiştir. Collegium Pontificum, sacra ve caerimoniae'nin korunması ve denetlenmesinden sorumluydu. Bu görev, Roma devletinin ve toplumunun ilahi güçlerle yapmış olduğu antlaşmalar ile bu antlaşmalar doğrultusunda dini hayatın bir parçası hâline gelen tören ve şölenlerin belirlenen biçimde, herhangi bir değişiklik ya da eksiklik olmaksızın sürdürülmesini sağlamayı kapsıyordu. Son derece dindar bir toplum olan Romalılar, devletlerinin varlığını ve refahını tanrıların lütfu ve onayıyla sürdürebileceklerine inanıyorlardı. Bu inanç, yaşamlarının neredeyse her alanında dini kurallara bağlı kalmalarına neden olmuştur. Öyle ki takvimlerini dahi dini inançlara göre düzenlemişler; bu bağlamda, takvimlerinde dies ater (kara/uğursuz gün) olarak tanımladıkları, hiçbir beşeri ya da ilahi işlemin uygun görülmediği günlerin olduğunu kabul etmişlerdir. Bu durum, sosyo-ekonomik ve hukuki bağlamda büyük önem taşıyan takvimlerinin Collegium Pontificum tarafından hazırlanmasına neden olmuştur. Bu suretle Collegium Pontificum, meclis toplantılarının, seçimlerin, dini törenlerin ve kurban ritüellerinin ne zaman icra edileceğine karar veren yegâne kurum olmuş; ayrıca bireyler arası yapılan akitlerin hangi günler içerisinde yapılıp yapılmayacağı konusunda da belirleyici rol üstlenmiştir. Bu durum, M.Ö. IV. yüzyılda Gnaeus Flavius'un dies ater günlerini açıkça belirten bir levha hazırlamasıyla son bulana dek devam etmiştir. Gnaeus Flavius'un bu bilgileri kamuya açık hâle getirmesi, Collegium Pontificum'un bu alandaki etkisini zayıflatmış görünse de, devlet işlerinin gerçekleştirilmesinde pontifex ve augur'ların onayına duyulan ihtiyaç, bu iki kurumun idari ve hukuki yapı üzerindeki etkisinin devam ettiğini göstermektedir. Romalıların dine atfettikleri yüksek değer, sacra kavramını idari ve hukuki birçok meseleyle doğrudan ilişkilendirir hâle getirmiştir. Her familia ve gens'in sahip olduğu dini sorumlulukları yerine getirmesi tanrılarla Romalılar arasındaki antlaşmanın devamı için hayati bir önem taşıdığı düşünülmüştür. Bu nedenle devletin tanrılara karşı yükümlülüklerinden biri olarak görülmekteydi. Bu nedenle, familia veya gens'in sacra içerisindeki sorumluluklarını etkileyebilecek miras, evlat edinme ve evlenme gibi hukuki işlemler, aynı zamanda ius sacrum kapsamında değerlendirilmiştir. Böylece, sacra ile bağlantılı hususların ius pontificium'a göre yorumlanması gerekli hâle gelmiştir. Örneğin, bir kişinin adoptio işleminin ius pontificium'a uygun olup olmadığı, o kişinin değişen hukuki statüsü sonrası elde ettiği makamların geçerliliğini belirleyen temel unsurlardan biri olmuştur. Bu nedenle, kamuya ve şahıslara ilişkin birçok işlem, Collegium Pontificum tarafından verilen responsum ve decretum aracılığıyla hükme bağlanmıştır. Cumhuriyet döneminde dahi Senatus'un, özellikle evlenme, evlat edinme, miras ve adaklara ilişkin konularda karar almak için pontifex'lerden görüş istemesi, bu kurumun yetkisini koruduğunu ortaya koymaktadır. Öyle ki, ceza hukuku kapsamında yer alması gereken incestus yargılamaları dahi sacra et caerimoniae'ya tehdit oluşturduğu gerekçesiyle doğrudan Collegium Pontificum'un denetimine bırakılmıştır. M.Ö. 133 yılında çıkarılan lex Peducaea ile incestus suçuna ilişkin yargılama yetkisi kamu mahkemelerine devredilmişse de, bu uygulama uzun süreli olmamış ve İmparatorluk döneminde söz konusu yetki tekrar Collegium Pontificum'a verilmiştir. Bir yerin beşeri alandan ilahi alana geçişini sağlayan dedicatio ve consecratio işlemlerinin ius sacrum'a uygunluğunu belirleyen yegâne kurum da Collegium Pontificum olmuştur. Bu işlemlerin uygunluğunun tespitinden sonra, söz konusu yerlerin hukuki statüsü, Collegium Augurum tarafından yönetilen karmaşık ritüeller aracılığıyla değişmiş ve ius civile ile ius publicum'un kapsamındaki yerler, ius sacrum'un parçası hâline gelmiştir. Böylece her iki collegium, pek çok işlemin gerçekleştirilmesinde birbirini tamamlayan roller üstlenmiştir. Roma dini hukukunun idari ve hukuki yapıyı etkileyen bir diğer önemli unsuru ise inauguratio işlemidir. Bu işlem, Roma toplumunu temsil etmek üzere seçilen kişilerin görevlerine başlamalarının ön koşuludur. Dini hukuk kurallarına göre elde edilen alametlerin değerlendirilmesiyle bu kişilerin görevleri ya meşrulaştırılır ya da seçimler tekrarlanırdı. Romalılar, augurlar aracılığıyla elde ettikleri alametlere büyük önem atfetmiş; meclis toplantıları, ordu sevkiyatı gibi birçok devlet işinde tanrılardan gelen işaretlerin belirleyici rol oynamasını sağlamışlardır. Krallık döneminde ortaya çıkan bir diğer önemli dini kurum olan Collegium Fetialium ise Romalıların savaşlarda zafer elde edebilmek için tanrıların desteğine ihtiyaç duydukları inancına dayalı olarak Roma dini sistemine dâhil edilmiştir. Roma'nın, Latium'daki diğer Latin şehirleriyle gerçekleştirdiği foedus (antlaşma) ve votum (yemin) gibi işlemlerde, bu antlaşmalara sadık kalınacağı ilahi varlıklar huzurunda taahhüt edilmiştir. Fetialis makamı, Roma'nın bu antlaşmalara riayet edeceğini göstermekle kalmamış; aynı zamanda, Latin kentlerine karşı yürütülen savaşların hem dini hem hukuki açıdan meşru olduğunu ispatlama işlevi görerek, Roma'nın yayılmacı politikalarını dini hukuk aracılığıyla meşrulaştırmıştır.

Rome initially emerged as a kingdom in the historical process and later transformed into a republic and ultimately an empire. During this transformation, it came to dominate significant parts of Europe, Africa, and Asia. Thus Roman civilization created profound influences in many areas within the territories under its rule; among these, perhaps the most enduring and significant is Roman Law, traces of which can still be seen in the legal systems of many countries today. The offices and rules established by the kings who ruled Rome especially Romulus, who was regarded by the Romans as the founder of their city, and his successor Numa Pompilius were formulated in response to emerging needs and problems and laid the foundation for the administrative and legal systems of the republican era. Since almost all of these structures that emerged during the monarchy period had a religious character, this religious influence continued to exist during the republican period as well. Institutions such as the Collegium Pontificum, Collegium Augurum, and Collegium Fetialium, which were established during the monarchy period, not only formed an inseparable part of the religious structure but also deeply affected Rome's administrative and legal framework. The Collegium Pontificum was responsible for the preservation and supervision of the sacra and caerimoniae. This duty encompassed ensuring that the agreements made by the Roman state and society with divine powers, and the ceremonies and feasts that became part of religious life in accordance with these agreements, continued to be carried out in the prescribed form without any alterations or deficiencies. As an extremely pious society, Romans believed that their state's existence and prosperity depended on the grace and approval of the gods. This belief led them to adhere to religious rules in almost every aspect of their lives. They even arranged their calendar according to religious beliefs; in this context, they acknowledged the existence of days defined as dies ater during which no human or divine action was considered appropriate. This situation led to the preparation of their calendars which held great importance in socio-economic and legal terms by the Collegium Pontificum. In this way, the Collegium Pontificum became the sole institution deciding when assembly meetings, elections, religious ceremonies, and sacrificial rituals would be held, and also played a decisive role in determining on which days contracts between individuals could or could not be concluded. This continued until the 4th century BCE, when Gnaeus Flavius prepared a public tablet clearly indicating the dies ater days. Although Gnaeus Flavius' public disclosure of this information may have appeared to weaken the influence of the Collegium Pontificum in this area, the continued necessity of obtaining approval from the pontifices and augures for carrying out state affairs indicates that these two institutions retained their impact on the administrative and legal system. The high value Romans attributed to religion brought the concept of sacra into direct connection with many administrative and legal matters. The performance of religious duties held by each familia and gens was considered vital for the continuation of the covenant between the Romans and the gods. Thus it was seen as one of the state's obligations towards the gods. Therefore, legal transactions such as inheritance, adoption, and marriage that could affect the responsibilities within a familia or gens's sacra were also evaluated under ius sacrum. Consequently, matters related to sacra had to be interpreted in accordance with ius pontificium. For example, whether an individual's adoptio process complied with ius pontificium was one of the fundamental factors in determining the legal validity of the offices obtained after the change in that individual's legal status. Hence, many public and private transactions were concluded through the responsum and decretum issued by the Collegium Pontificum. Even during the republican period, the fact that the Senatus consulted the pontifices on matters such as marriage, adoption, inheritance, and votive offerings demonstrates that this institution preserved its authority. So much so that incestus trials, which should have fallen under the scope of criminal law, were placed directly under the supervision of the Collegium Pontificum due to the belief that they posed a threat to sacra et caerimoniae. Although the lex Peducaea, enacted in 133 BCE, transferred the authority to judge incestus offenses to public courts, this practice did not last long, and during the imperial period, the said authority was once again entrusted to the Collegium Pontificum. The Collegium Pontificum was also the sole institution authorized to determine whether the dedicatio and consecratio processes through which a place transitioned from the human to the divine realm complied with ius sacrum. Following the determination of the appropriateness of these procedures, the legal status of such places changed through strict and complex rituals overseen by the Collegium Augurum, and places formerly within the scope of ius civile and ius publicum became part of ius sacrum. Thus, both collegia undertook complementary roles in the execution of many procedures. Another significant element of Roman religious law that influenced the administrative and legal structure was the inauguratio process. This process was the prerequisite for officials elected to represent Roman society to assume their duties. Through the evaluation of omens obtained in accordance with religious legal rules, such appointments were either legitimized or elections had to be repeated. The Romans attributed great importance to the omens obtained through the augures, ensuring that signs from the gods played a decisive role in many state matters such as assembly meetings and military deployments. Another important religious institution established during the monarchy period was the Collegium Fetialium, which was incorporated into the Roman religious system based on the belief that divine support was necessary for victory in wars. In procedures such as foedus (treaty) and votum (vow), conducted by Rome with other Latin cities in Latium, it was pledged in the presence of divine beings that these treaties would be honored. The office of fetialis not only demonstrated Rome's commitment to adhering to these treaties but also served to justify, both religiously and legally, the wars waged against other Latin cities, thereby legitimizing Rome's expansionist policies through religious law.
