Özet

Diş hekimleri ile hastalar arasındaki sözleşmesel ilişkinin niteliği diş hekiminin müdahalesinin amacına, kapsamına ve mahiyetine göre belirlenmektedir. Ancak diş hekimi tarafından müdahalenin amacında ve uygulanmasında estetik bir yönün olup olmaması ve dolayısıyla aradaki ilişkinin eser veya vekâlet sözleşmesine göre mi değerlendirileceği günümüzde çok net çizgilerle belirlenmiş durumda değildir. Diş hekimliğinin günümüzde geldiği nokta, tedavi uygulanırken aynı zamanda tedavinin sonucunun her zaman estetik değerlere uygun olmasıdır. Böylece diş hekimlerinin uyguladıkları tedavilerin neredeyse tamamında estetik amaç güdülmektedir. Dişlerin ve ağzın bir bütün olarak görüntüsünün kişilik üzerindeki önemi sebebiyle diş hekimlerinin endikasyon ve estetik müdahale ayrımını keskin biçimde yapmaları gün geçtikçe daha da zorlaşmaktadır. Yargıtay'ın yıllardır istikrarlı biçimde benimsediği görüşüne göre diş hekimi ve hasta arasındaki ilişki iyileştirme amaçlı bir uygulama ise vekâlet sözleşmesi bulunur. Günümüzde teknolojinin ilerlemesi, toplumsal yaşamın sosyolojik boyutları, ihtiyaçların değişmesi ve gelişmesi gibi sebeplerle diş hekimlerinin müdahalelerini estetik kaygıdan ayrı biçimde sadece iyileştirme amaçlı değerlendirmek zorlaşmıştır. Somut uyuşmazlıklar hakkında Yargıtay'ın değerlendirmelerinde ve uygulamalar hakkında alınan bilirkişi raporlarında iyileştirme veya estetik amaç ayrımı detaylandırılmamakta ve açıkça ortaya koyulamamaktadır. Hukukumuzda diş hekimleri ve hekimler aynı düzenlemelere tabidirler. Diş hekimleri mesleklerini icra ederken davranışlarından sorumlulukları hakkında açıkça ve özel olarak düzenlenmiş bir kanun hükmü bulunmamaktadır. Yargıtay ve doktrin görüşleri değerlendirildiğinde; diş hekiminin müdahalesi tedavi kapsamında hastayı iyileştirme amaçlı bir müdahale ise vekâlet sözleşmesi hükümleri uygulanır. Hastanın vücudunda doğal olarak bulunmayan, diş hekiminin müdahalesiyle sonradan ve sonuç sözü verilerek oluşturulmuş bir eserin meydana getirildiği müdahaleler ise eser sözleşmesi kapsamında değerlendirilmektedir. Somut hukuki uyuşmazlıklar uygulamada Türk Borçlar Kanunu hükümlerine göre çözümlenmeye çalışılmaktadır. Bu çerçevede çalışmada öncelikle diş hekimi ve estetik müdahaleleriyle ilgili temel kavramlar açıklanacak, diş hekimlerinin estetik müdahale türleri hakkında bilgi verilecektir. Diş hekimi ile hasta arasında sözleşmenin kurulması için gerekli koşullar ile kurulan sözleşmenin hukuki niteliği ve özelliklerinden bahsedildikten sonra diş hekimlerinin estetik müdahalelerindeki sözleşmesel yükümlülükleri üzerinde durulacaktır. Sözleşmesel ilişkinin ortaya koyulmasından sonra diş hekimlerinin sözleşmeyi ihlalleri halinde doğacak sorumlulukları ve son olarak hastaların tedavi sürecindeki davranışlarının diş hekiminin sorumluluğuna etkisi ortaya konularak diş hekimlerinin estetik müdahalelerindeki sözleşmesel sorumlulukları bir bütün olarak ele alınmaya çalışılacaktır.

The nature of the contractual relationship between dentists and patients is determined by the purpose, scope, and nature of the dentist's intervention. However, whether there is an aesthetic aspect in the purpose and application of the intervention by the dentist and consequently whether the relationship should be evaluated under a contract for services or a mandate contract, is still not clearly defined today. The current state of dentistry emphasizes that the outcome of treatment should almost always comply with aesthetic standards. As a result, nearly all treatments applied by dentists have an aesthetic purpose. Given the importance of the appearance of teeth and the mouth as a whole on an individual's personality, it is becoming increasingly difficult for dentists to make a clear distinction between medical indication and aesthetic intervention. According to the long-standing consistent view of the Yargıtay, the relationship between a dentist and a patient is one of mandate, based on the aim of treatment and the dentist's professional duty to improve health. However, due to advancements in technology, the evolving sociological dimensions of social life and changing needs, it has become harder to assess dental interventions purely as health-improving acts, separate from aesthetic concerns. In practical disputes, both the evaluations of the Court of Cassation and expert reports do not clearly elaborate or distinguish between treatments for health and those for esthetics. Under Turkish law, dentists and physicians are subject to the same regulations. There is no specific legal provision that explicitly governs the responsibilities of dentists arising from their conduct while practicing their profession. According to the Court of Cassation and doctrinal opinions, if the relationship between the dentist and the patient involves treatment that the dentist deems necessary for the patient's health, based on their expertise, it is assessed under the provisions of mandate contracts. Interventions in which a work is produced as a result of the dentist's actions—where the outcome is promised in advance and entails the creation of something not naturally present in the patient's body—are evaluated within the scope of a contract for work. In practice, concrete legal disputes are attempted to be resolved according to the provisions of the Turkish Code of Obligations. Within this framework, the study will first explain the fundamental concepts related to dentists and aesthetic interventions and provide information on the types of aesthetic procedures performed by dentists. After discussing the conditions required to establish a contract between a dentist and a patient, along with the legal nature and characteristics of such contracts, the focus will shift to the contractual obligations of dentists regarding aesthetic interventions. Following the presentation of the contractual relationship, the potential liabilities arising from a dentist's breach of contract and finally, the impact of the patient's conduct during the treatment process on the dentist's liability will be examined, with the aim of addressing the contractual liability of dentists in aesthetic interventions as a whole.
