Özet
Bu tez modern toplum sözleşmeleri olarak addedilen anayasal metinlerde ve yapım süreçleri ile bunlara bağlı olarak verilen yargı kararlarında kadının yerini Kurucu Babalar kavramsallaştırması üzerinden incelemektedir. Tez iki bölümden oluşmaktadır. İlk bölümde Kurucu Babalar'ın kimler oldukları, modern devletin kuruluş aşaması, toplum sözleşmeleri teorileri ve toplum sözleşmesinden dışlananlar ile bu dışlama ile cinsel sözleşme kapsamında getirilen eleştiriler ile bu doğrultuda kurucu iktidar ve kurucu iktidarın niteliği incelenmiştir. İkinci bölümde ise toplum sözleşmesinden dışlama durumlarının anayasa yapım süreçlerine ve metinlerine nasıl yansıdığı, bu bağlamda verilen AİHM, AYM gibi yüksek mahkeme kararları incelenmiştir.

This thesis examines the position of women within constitutional texts -often regarded as modern social contracts and the judicial decisions based on them, through the conceptual lens of the“Founding Fathers.”The thesis is structured in two main parts. The first part explores who the Founding Fathers were, the foundational phase of the modern state, the theories of the social contract and the exclusionary nature of such contracts. It further engages with feminist critiques, particularly those articulated within the framework of the“sexual contract,”and discusses the concept and nature of constituent power in this context. The second part investigates how the exclusion of women from the social contract is reflected in constitutional drafting processes and texts, and examines how the judgments of high-level courts, such as the European Court of Human Rights (ECHR) and the Constitutional Court of Turkey (AYM), are evaluated in this context.
