Özet

Temel hak ve özgürlüklerin korunması ve etkin bir şekilde kullanılmasını sağlamak devletin“varlık”sebebidir.1 Devletin mutlak egemenliğinin sınırı olarak Anayasa ile hukukun üstünlüğü temelinde insan haklarını koruma ve gerçekleştirme idealini en üst düzeyde sağlanmaya çalışmak da devletin esas görevidir. Özü itibarıyla toplumsal eşitsizliklerden kaynaklanan sakıncaları gidermeye yönelen sosyal ve ekonomik hakların, ekonomik açıdan güçsüz kesimlerin korunması amacıyla devlete ekonomik kaynaklarını harekete geçirme yükümlülüğü yüklemesi, diğer insan haklarından daha zayıf korunmasına neden olabilir. Bireylerin sosyal ve ekonomik haklardan tam anlamıyla yararlanabilmeleri amacıyla devletin yasal, yönetsel, mali, yargısal ve diğer tüm önlemleri alması şeklinde ifadesini bulan insan haklarının“gereğini yerine getirme”yükümlülüğü, uygulamada sosyal ve ekonomik haklar karşısında, devletin sorumluluğunu hemen hemen tümüyle“pozitif bir yükümlülük”olarak ortaya çıkaran bir edim türü ve hatta bu hakları diğer haklardan ayıran en belirgin, somut ve makul bir ayrım sebebi kabul edilmektedir. Anayasa'nın İkinci Kısmının Üçüncü Bölümü'nde yer alan“Sosyal ve Ekonomik Haklar ve Ödevler”başlığı altında tanınan anayasal sosyal hakların devlete yüklediği pozitif yükümlülükler sadece bu hakların düzenlendikleri maddelerle sınırlı değildir. Her şeyden önce Cumhuriyet'in nitelikleri ve sosyal bir devlet olmanın gereği ile Devletin temel amaç ve görevleri kapsamında Anayasa'nın bütünlüğü ilkesi, bu sınırın ötesinde bir sorumluluk yükler. Nitekim temel hak ve özgürlüklerin bölünmezliği ve sosyal haklara ilişkin pozitif yükümlülüklerin gereği gibi yerine getirilip getirilmemesi sorununun kişisel hakları da etkilemesi Anayasa Mahkemesi tarafından sosyal hakların“hakların bütünselliği”çerçevesinde ele alınmasına yol açmıştır. Benzer şekilde, söz konusu hakların sınırlandırılması konusu da yalnızca Anayasa'nın“Sosyal ve Ekonomik Haklar ve Ödevler”başlığı altında devlete tanınan takdir yetkisini genişleten 65. maddesi ile bağlı kalmadan, sosyal devlet ilkesi ve hakların bütünselliği ilkesi ile yorumlanmalıdır. Bu anlamda, devletin sosyal ve ekonomik haklarda asgari bir koruma düzeyini sağlamakla yükümlü olduğu, bu yükümlülüklerin yargısal denetime bütünüyle kapatılamayacağı, Anayasa'nın 65. maddesinin devlete tanınan yükümlülüklerden kaçınma fırsatı olarak ileri sürülemeyeceği kabul edilmelidir. Çünkü, devletin sosyal ve ekonomik alandaki edimlerinin sınırlarının belirlenmesi meselesi, yalnızca siyasal bir tercih alanı değil, aynı zamanda anayasal denetimin ve temel hakların etkin korunmasının da bir parçasını oluşturmaktadır. İnsan hakları arasından bir kısmını çıkarmak veya ihmal etmek bütünlüğü bozar ve diğer hakları da anlamsız hâle getirir. Dahası insan onurunu zedeler.

The protection of fundamental rights and freedoms and the guarantee of their effective enjoyment constitute the very raison d'être of the State. In this respect, it is also among the State's core duties to strive for the highest possible realisation of the ideal of protecting and implementing human rights through the Constitution, which operates as a limit on the State's absolute sovereignty, and through the assurance of the rule of law. Economic, social and cultural rights are inherently aimed at addressing the disadvantages arising from social inequalities. They primarily seek to protect economically disadvantaged groups and impose on the State an obligation to mobilise its economic resources. These characteristics may result in these rights receiving a comparatively weaker level of protection than other categories of human rights. The obligation of the State to give effect to human rights is expressed through the adoption of all necessary legislative, administrative, financial, judicial and other measures to ensure that individuals can fully and effectively enjoy their economic, social and cultural rights. In practice, it is within the context of this obligation that the distinction between civil and political rights and economic, social and cultural rights becomes most pronounced and concrete. Accordingly, the State's responsibility in relation to these rights is manifested almost entirely in the form of positive obligations. The positive obligations imposed on the State by constitutional social rights recognised under the heading“Social and Economic Rights and Duties”in Chapter Three of Part Two of the Constitution are not confined solely to the specific provisions in which these rights are expressly regulated. First and foremost, the principle of the unity of the Constitution, interpreted in light of the fundamental characteristics of the Republic, the requirements of a social state, and the fundamental aims and duties of the State, imposes responsibilities that extend beyond these textual limits. Furthermore, the principle of the indivisibility of fundamental rights and freedoms, together with the fact that the proper fulfilment or non-fulfilment of positive obligations relating to social rights directly affects individual rights, has led the Constitutional Court to assess social rights within the broader framework of the indivisibility of rights. Likewise, the Court has taken the view that limitations on these rights cannot be examined solely through Article 65 of the Constitution— a provision open to interpretation as expanding the State's margin of discretion in the field of social and economic rights. In accordance with the principle of the social state and the principle of the indivisibility of rights, the State is under an obligation to secure a minimum level of protection, and these obligations cannot be entirely removed from judicial scrutiny. In this context, Article 65 of the Constitution cannot be interpreted as providing the State with an opportunity to evade its responsibilities. The determination of the limits of State action in the social and economic sphere is therefore not merely a matter of political choice, but also an integral part of constitutional review and the effective protection of fundamental rights. Excluding or neglecting certain human rights undermines their indivisible nature, renders other rights ineffective, and ultimately infringes upon human dignity.
