Özet
Tez, iş görme sözleşmesinin bir türünü oluşturan vekalet sözleşmesinde, iş görme borçlusu olan vekilin işi görürken göstermek zorunda olduğu özen borcunu konu edinmektedir. Tez, giriş ve sonuç dışında üç ana bölümden oluşmaktadır. Birinci bölümde; vekalet kavramı, vekalet sözleşmesinin tanımı ve benzer kurumlardan ayrımı incelendikten sonra, vekalet sözleşmesinin unsur ve özellikleri incelenmiştir. İkinci bölümde, özen kavramı açıklandıktan sonra özen borcunun vekalet sözleşmesindeki kanuni düzenleniş biçimi, hukuki niteliği, kapsamı, sınırları üzerinde durulmuştur. Devamında, vekilin özen borcunun vekilin vekaletten kaynaklanan diğer borçlar ile olan ilişkisi ve vekalet sözleşmesinin çeşitli görünümlerinde (avukatların, hekimlerin, özel okulların vs.) vekilin özen borcu incelenmiştir. Üçüncü ve son bölümde ise, vekilin özen borcuna aykırılıktan kaynaklanan sözleşmeye dayalı sorumluluğu ve sorumsuzluk anlaşmaları incelenmiştir. Tez, vekalet sözleşmesinde iş görme borçlusu olan vekilin özen borcu ile ilgili değerlendirmelerden oluşan sonuç kısmı ile sona ermiştir.

ABSTRACT Our study mainly aims at investigating the obligation of“ diligent act”falling on the part of the procurator as a party to the Mandatum contract as a type of project accomplishing contracts. The thesis is composed of three main parts as well as an introduction and a conclusion to it. In the first part as a legal concept the definiton of the Mandatum contract and of its elements, together with its distinction from the similar concepts are studied with the related legal provisions. In the second part after having studied the concept of diligence and the obligation of diligent act in Mandatum contract we further our study by the obligation of diligent act falling on the part of the procurator in compension to other obligations arising from the same contract and the different appearances of the same type of contract in different cases such as the proceration accomplished by medical doctors, solicitors and privately run-schools etc. In the third and final part we conculude by studying the cases where the procurator has acted against this obligation conferned upon him by the contract and the cases where this obligation has been released on his part previously at the time of the enactment of the very contract. We finally conclude by a general assesment thus evaluating the obligation of "diligent acf on the part of the procurator in Mandatum contract.
