Özet
Dünyanın `küreselleşme' olarak anılan bir sürece girdiği fikrinin yaygın kabul gördüğü 1990'lı yılların başından bu yana, uluslararası siyasette `insan hakları' kavramı son derece önemli bir yapıtaşı olarak işlev görmektedir. Başta gelişkin metropol ülkeler olmak üzere, uluslararası siyasetin tayin edici aktörleri `insan hakları' söyleminden yola çıkarak çevre ülkelere politik-ekonomik dönüşüm reçeteleri sunabilmekte, hatta aynı gerekçeyle askeri müdahalelerde dahi bulunabilmektedir. Söz konusu söylem, üzerinde tartışma götürmez bir evrensel uzlaşma bulunduğu varsayımıyla dünyanın yeniden yapılandırılmasında ideolojik manipülasyonun etkili bir aracı durumuna dönüştürülebilmektedir.Günümüzün revaçtaki `insan hakları' algısı, kendi `hak' ve `özgürlük' anlayışının gerek içerdiği, gerekse dışladığı öğeleri belirsiz kılarak mutlaklaştırıcı, tekçi ve hatta totaliter bir mite dönüşme tehlikesiyle karşı karşıyadır. Bu durum, insan hakları savunucularınca dışavurulan `çoğulcu', `demokratik' saiklerle yan yana getirildiğinde ironiktir.Tez çalışması, `küreselleşme' ile birlikte anılan `insan hakları' söyleminin örtülü olarak içinde barındırdığı `hak' ve `özgürlük' tahayyülünü çözümlemeyi denemiştir. Bunu denerken, modern `hak' ve `özgürlük' kavramlarına kaynaklık eden `Aydınlanma Çağı'ndan bu yana söylemin hangi değişik evrelerden geçerek dönüştüğü, bu evrelerde ne tür dinamikler tarafından belirlenip etkilendiği üzerinde durulmuş, nihayet aynı yöntem günümüze de uyarlanmıştır. Zira bu çalışmada ortaya konulan sav, tarihin hiçbir döneminde `yansız' ve hakikatte `tüm insanlık yararına' bir `insan hakları' anlayışından söz edilemeyeceğidir. `Haklar' bir başkasının tecavüzünden korunmak için var olmak zorunda ise eğer, korunmaya değer hakkın çerçevesini kimin hangi ölçütlerle doldurduğu ve neye, kime karşı koruduğu sorularına cevaplar aranmıştır. Soğuk Savaş sonrası `küreselleşme' sürecine tabi tutulan `insan hakları' söylemi bu hakkı elinde tutan özneler tarafından `yeniden inşa' edilmektedir.

In the early 1990s, the idea that the world has entered the phase of ?globalization? process has gained an immense popularity in international arena, and, since then, the notion of ?human rights? has also played a constitutive role in the structuring of international politics. One can observe that by taking the discourse of ?human rights? as a point of departure, the advanced capitalist countries, as well as some other powerful policy making actors of international politics, have been able to impose certain ?recipes? for the political and economic transformation of peripheral countries. It is also well-known that the same discourse has also been used to justify some military interventions into the sovereignty of these peripheral countries. By virtue of the assumption that there is an indisputable universal consensus on the meaning of human rights, this discourse has been transformed into an effective tool of ideological manipulation that is deployed to justify the process of the restructuring of the world politics.To the extent that the dominant perception of ?human rights? has remained ambiguous with respect to the scope and content of its own conception of ?rights? and ?freedoms?, there exists an imminent danger that the discourse of human rights could be transformed into a ?monist?, ahistorical and even a totalitarian myth. It is quite ironic that in the wake of such a danger, the proponents of the discourse of human rights, as such, put forward the ?virtues? of pluralism and democracy.This thesis attempts to analyze the conceptions of ?rights? and ?freedoms? as the elements that are latently ingrained in the discourse of human rights and globalization. While so doing, the thesis investigates the historical process through which the discourse of human rights have been transformed by various social forces since the Age of Enlightenment, where the modern sense of rights and freedoms have been rooted. Accordingly, the main argument of this thesis is that, throughout history, there has never existed a notion of a true, universal and neutral conception of human rights that would be beneficial for the entire humanity. If what is called ?rights? are assumed to exist for getting protection from the aggression of the others (enemies), the whole content of these ?rights? would vary in accordance with the identity of those actors who have the power to shape the scope of these ?rights? in such a way as to get better protection from their own actual or potential enemies. In this vein, it can be argued that the discourse of ?human rights?, which has been ?globalized? in the aftermath of the Cold War, has been reconstructed in a way that it could provide protection for those actors who have the power to reshape it.
