Özet
Kişinin serbestçe irade oluşturma ve iradi olarak hareket etme hürriyeti ile hukuki emniyet duygusunu korumak amacıyla, 5237 sayılı Türk Ceza Kanunu'nun hürriyete karşı işlenen suçlar bölümünde tehdit suçu düzenlenmiştir.Tez konumuzu, suç tipi olarak tehdit suçu oluşturmaktadır. Tezimiz, iki bölümden oluşmaktadır. Birinci bölümde hürriyet kavramı, hürriyetin anayasa hükümleri ve ceza yasalarıyla korunması, tehdidin tanımı, yeni düzenleme ile 765 sayılı TCK'da yer alan tehdit suçu arasındaki farklar, karşılaştırmalı hukuktaki düzenlemeler, tehdit suçunun benzer suçlardan farkları, tehdit suçuyla korunan hukuki değer, suçun unsurları ve kusurluluğu etkileyen sebepler açıklanmıştır. İkinci bölümde ise tehdit suçunun nitelikli halleri, özel görünüş şekilleri, muhakemesi ve yaptırımı incelenmiştir.

The crime of threat is regulated in the chapter crimes against liberty in Turkish Penal Code (TCK) No 5237 in order to protect the legal sense of safety and the freedom of estabilising a person?s will freely and acting volitionally.Subject of the thesis is the crime of threat. The study is composed of two parts. In the first part, the consept of freedom, the protection of liberty in constitution and penal codes, the definition of threat, differences of crime of threat between new penal code and TCK No 765, the regulations in comparative law, the differences among crime of threat and similiar ones, the legal benefit of crime, the components of crime and reasons effecting wantonness are explained. In the second part, the qualfied situations of crime, the special appearences of crime, the prosecution procedures and sanction of crime are studied.
