Özet
Tehdit suçu, başlangıçtan günümüze ceza hukukunda suç olarak düzenlenmiştir. Tehdit fiili ile bir kişinin iç huzuru bozulduğundan suç sayılmıştır. Tehdit fiili mağdurun karar veya hareket hürriyetini tehlikeye koyması nedeniyle Türk Ceza Kanununda hürriyete karşı suçlar arasında yer verilmiştir. Bu nedene çalışmada öncelikle hürriyet kavramı ve hürriyet aleyhine işlenen suçlar üzerinde kısaca durulduktan sonra, 5237 sayılı Türk Ceza Kanununda düzenlenen tehdit suçunun, 765 sayılı Türk Ceza Kanunundaki düzenlemesi ile karşılaştırılması, suçun unsurları, özel görünüş şekilleri, unsurlar dışında kalan diğer haller, soruşturma ve kovuşturma usulü ile yaptırım gibi konuları Yargıtay kararlarından da alıntı yaparak inceleyeceğiz.

The crime of Threat has been issued as a crime in criminal law. It is considered as a crime because actual threat of a criminal offense deteriorates a person's inner peace. actual threat has been included among crimes against liberty by the Turkish Penal Code because the crime puts in danger victims freedom of movement and The decision. For this reason, firstly we will study the concept of freedom and committed the crimes against liberty briefly, and then we will compare the regulations of crime of threat between No:5237 of Turkish Penal Code and No. 765 of Turkish Penal Code and, the elements of the crime, special appearance shapes, elements other than the cases, procedural issues of investigation and prosecution with sanctions from the Supreme Court decisions also will be reviewed.
