The Law on Protection of Competition numbered 4054 (the Competition Law), which entered into force on 13 December 1994, the civil law sanctions are also regulated alongside the administrative sanctions. Such civil law sanctions are mostly the indemnification clauses set forth in Article 56 and the following articles of the Competition Law regarding the compensation of the damages arising from actions which constitute competition law breaches. The main motive of the legislator in regulating the indemnification clauses relating to the compensation of the damages arising from competition law breaches is to ensure and protect the competition in the markets rather than mere compensation of the damages of the concerned undertakings. Calculation of damages in compensation lawsuits to be filed in accordance with the indemnification clauses provided under the Competition Law has great importance in determination of the compensation amount, as the amount of the damages usually constitutes the basis for the compensation amount. The damages arising from competition law breaches do not necessarily have a single type or form and likewise, it is not possible to calculate the damages with a single method. Therefore, different methods including technical analyses are needed for the calculation of these damages. The most striking provision among the indemnification clauses in the Competition Law is the one about the treble damages. Pursuant to paragraph 2 of Article 58 of the Competition Law, if the necessary conditions are maintained, the judge may tender treble compensation penalty upon request of the claimant. With this principle, the legislator left the main rules in the Turkish Code of Obligations such as ?the incurred damages determine the upper limit of the compensation amount?. The main objective of the legislator with this treble damages is to encourage the damaged undertakings to initiate compensation lawsuits and thus, to ensure the efficiency and competition in the markets. Finally, as the indemnification clauses and compensation lawsuits for damages arising from competition law breaches are considerably new subjects in Turkish legal system, and with regards to the progress in US and European Union regulations and practices, it is not difficult to envisage that such antitrust damage actions will become more important and will be referred to a lot often in the near future.
