Özet
İslam ceza hukukunda suçun tekerrürünün incelendiği bu çalışma giriş, üç bölüm ve sonuç kısmından oluşmaktadır.“İçerik ve Yöntem”başlığı altında konunun önemi ve konunun sınırlan hakkında bilgi verilmiştir. Bunun yanında kullanılan kaynaklar değerlendirilmiştir. Bundan sonra suçun tekerrürünün de içinde bulunduğu cezayı ağırlaştıran sebepler hakkında bilgi verilmiştir. Konunun anlaşılması amacıyla genel bilgilerin verildiği birinci bölümde, tekerrür kavramı açıklanmaya çalışılmıştır. Daha sonra cezaların içtimai, suçta itiyad gibi tekerrüre benzeyen kavramlarla tekerrürün ilişkisi incelenmiştir. Ardından tekerrürün uygulanmasında yöneticinin rolü konusu siyasetüş-şeriyye kavramı çerçevesinde incelenmiştir. İkinci bölümde Tekerrür hükümlerinin uygulanması için gereken şartlar incelenmiştir. Daha sonra tekerrürün çeşitlerine değinilmiş ve İslam ceza hukukunun bu konudaki tercihlerine değinilmiştir. Üçüncü bölümde ise tekerrürün cezayı nasıl ağırlaştıracağı incelenmiştir. Sonuç bölümünde ise genel değerlendirme yapılarak ulaşılan sonuçlar belirtilmiştir.

This study on the repetition of the crime in punishment law of Islam consists of an introduction, three chapters and the conclusion. In the“Contents and Method”part in the Introduction, there is the information about the importance and restrictions of the subject and sources which are used in this study. Then, it gives information about the causes - one of which is the repetition of crime - that make the punishment more severe. In the first chapter, there is a general information that aims to explain the concept of 'repetition'. Thirdly, the relationship between the repetition and the concepts like 'gathering and habit' is analyzed. Afterwards, the role of the manager in the application of the repetition in terms of the concept 'siyasetus-seriyye' is studied. In the second chapter, there is information about the conditions that are necessary to make the punishment more severe because of the repetition of the crime is analyzed and then, the kinds of the repetition are stated and the preferences of Islamic criminal law about this subject are indicated. In the third chapter, how the repetition of crime make the punishment more severe is analyzed. Finally, in the conclusion, a general evaluation is formed and the results that are attained are explained.
