Özet
Bu çalışmanın konusu ?Borçlu Temerrüdünün Sona Ermesi? dir. Borçlu temerrüdü borca aykırılığın özel bir halini teşkil eder. Temerrüt halinde borcun ifa edilmemesi değil, ifanın gecikmiş olması söz konusudur.Borçlar hukukunun temel kavramlarından birini oluşturan borç veya borç ilişkisinin temel amacı ?borcun ifası? dır. İfa, borçlanılan edimin borçlu veya üçüncü kişi tarafından tam ve doğru bir şekilde yerine getirilmek suretiyle, alacaklının tatmin edilerek borcun sona erdirilmesidir. Böylece, ilk akla gelen borçlu temerrüdünün sona erme sebebi ifa'dır.Borç ilişkisinin diğer kurucu unsuru ve konusu edimdir. Edim kavramı hem ?Edim fiili? hem de ?Edim sonucu? nu kapsayacak şekilde iki farklı anlamda kullanılmaktadır. Bu durum uygulamada pek çok problemin ortaya çıkmasına sebep olmaktadır. Burada söz konusu problemlere çözüm üretilmeye çalışılmıştır.Bu çalışmanın giriş kısmında konu hakkında genel bilgiler verilmiştir. Birinci bölümde temerrüt kavramı ayrıntılı bir şekilde incelenmiştir. İkinci bölümde ifada gecikme ve ifada gecikmenin hangi hallerde borçlu temerrüdüne sebep olacağı ele alınmıştır. Çalışmanın üçüncü bölümünde edim fiilî veya edim sonucunun gerçekleşmesiyle temerrüdün sona ermesi incelenmiştir. Son bölümde ise, ifa safhasında üçüncü şahsın iştirakiyle ve ifa gerçekleşmeksizin edimin teslim alınması yoluyla temerrüdün sona erme halleri ele alınmıştır.

The subject of this study is ?the Extinction of the Default of Obligor?. The default of obligor is a particular kind of contradiction to obligations. In case of default, there exists a delay in fulfillment rather than non-fulfillment.The main purpose of the debt or the debt relationship, which is one of the fundamental concepts of the law of obligations, is ?fulfillment of the debt?. The fulfillment stands for the extinction of the debt through full and properly satisfaction of the obligee by the obligor or a third party. In this context, the first prominent reason of extinction of the default of obligor is fulfillment.The other fundamental element and subject of the debt relationship is performance. The concept of performance is being used in two different meanings that cover both ?the act of performance? and ?the result of performance?. This situation, though, has led to emergence of a wide range of problems in practice. This study aims to provide solutions for these kinds of problems.The introduction section of this study provides the general context for the subject. In the first section, the concept of default is analyzed comprehensively. The second section deals with the delay in fulfillment and the circumstances of delay which can give rise to default. In the third section, the extinction of default through the act of performance or the result of performance is examined. In the last section, the extinction of default is taken into consideration for the cases where a third party participates to the performance of contract and where the performance is conducted without fulfillment by taking delivery.
