Özet
Bir Özerk İdari kurum olan Bilgi Teknolojileri ve İletişim Kurumunu incelediğimiz bu tezde, öncelikle bağımsız düzenleyici kurum kavramı tartışılmış ve bu kurumların temel özelliklerine değinilerek, dünyada ve Türkiye'deki gelişim süreçleri açıklanmıştır. Tezin odağında Bilgi Teknolojileri ve İletişim Kurumu bulunmaktadır. Konunun daha iyi anlaşılabilmesi için özellikle Avrupa ve Amerika Birleşik Devletleri'nde faaliyet gösteren düzenleyici kurumlar ile Türkiye'de faaliyet gösteren diğer bağımsız düzenleyici kurumların temel özellikleri ile görev ve yetkileri hakkında bilgi verilmiştir. Tezin ikinci bölümünde Kurumun İdari teşkilat içerisindeki yerinin tespiti yapılmaya çalışılmıştır. Bu bağlamda kurumun idari teşkilat içerisindeki yeri ve niteliği tartışılmıştır. Devamında Bilgi Teknolojileri ve İletişim Kurumunun amacı, görev ve yetkileri, nihai olarak da yapısı ortaya koyulmuştur. Üçüncü bölümde ise; Bilgi Teknolojileri ve İletişim Kurumunun çalışma usul ve yöntemi ortaya koyulmuş, kurumun düzenleyici faaliyetleri ve yaptırım yetkisinin kapsamı ortaya koyulmaya çalışılmıştır. Bu amaçla da kuruma ilişkin verilen Danıştay ve Anayasa mahkemesi kararları da incelenmiştir.

In this thesis which we analyze the Information and Communications Technologies Authority (ICTA) as an autonomous administrative institution, the concept of“independent regulatory agency”is firstly discussed. Then how these agencies flourish and work both in Turkey and the world under which conditions is explained, touching upon on particular basic features of independent regulatory agencies. This study centers on the ICTA. In order to understand basic characteristics of these type of agencies, first chapter of the study focuses on the missions, tasks and authorities of regularity agencies of the Europe and the United States, accompanied by the ones in Turkey. In the second chapter, it is intended to pinpoint where ICTA is located in administrative system, discussing its basic characteristics. Also, aims, tasks and authorities and, lastly, the structure of the ICTA has been revealed subsequently. Third chapter is related to working fashion and methods of ICTA along with its regularity activities and the scope of its sanctions. For that purpose, Council of the State and Constitutional Court decisions has been analyzed in order to understand limits of its jurisdiction and authority.
