This dissertation investigates obstacles and difficulties that need to be overcome in procuring engineering works under a design-build construction contract in relation to the latest edition of the FIDIC (1999) „Conditions of Contract for Plant and Design-Build, and the dissertation also investigates how client satisfaction is maximised in relation to scrutinising the general and particular conditions of the contract. The dissertation aimed to achieve this target by identifying and assessing the possible risks that can occur in engineering projects under FIDIC Conditions of Contract. In order to avoid possible legal and practical pitfalls and to reduce the overall risk of conflict in a design-build construction project, liabilities between all of the parties and general conditions of a standard form of contract are all aimed at diminishing the risk of misinterpretation. A brewery installation package in Romania is used as a case study in understanding the particular needs of an employer in a design-build project and the implementation of these requirements in the contract is also analysed so as to achieve successful procurement results.
