Following the fall of the USSR1, and the end of the Cold War, the developed countries and developing countries have started looking for ways to improve their economy. With the growing pace of international trade, energy investment has stood out as a beneficial contribution to the economies of the states. In this aspect, the multinational and bilateral trade and investment treaties have gained great deal of interest. Such a large scale trading brought about concerns and problems with itself. Multinational treaties such as the Energy Charter Treaty lays out the basic principles and rules for the trade, investment and the protection of parties, while many countries try to attract foreign investors with the Bilateral Investment Treaties they sign. This paper first analyses and answers the role of energy in global trade and Turkey then delves into the question whether the bilateral investment treaties are actually successful in attracting foreign investments despite the disputes arising between the host countries and the foreign investors. Since there are a number of cases of disputes of such, the arbitration is a key element in resolution. However, arbitration itself can be seen as a topic of discussion as Brower and Schill also argues that it may fail to keep up with the rapid growth of the field. In order to provide a better analysis, this paper will study the energy the foreign investment related to energy bearing in mind the policies and development plans of Turkey2, related foreign investment disputes in Turkey in 1 A socialist state on the Eurosian continent that existed from 1922 to 1991. 2 Gateway between Europe and Asia. the field of energy law, resolutions and its foreign policy. In this paper, the main features of the Energy Charter Treaty, which Turkey is a party to, and investment dispute settlement procedures under the Treaty will be examined. Having signed 105 Bilateral Investment Treaties with different countries (75 of them are in effect), Turkey's foreign investments -whether by Turkish investors in host countries or foreign investors in Turkey- have provided many examples for such cases despite the fact that Energy Charter Treaty does not have a long history, being signed in 1994 and effective of 1998. It should be, therefore, discussed in terms of the procedure of the arbitration cases. However, there is no doubt that international investors need to be protected through such mechanisms to the benefit of all parties included. At this point, the national regulations and political agenda may interfere with the foreign investment or the dispute resolutions. This paper aims to find out whether the international arbitration in solving disputes, which arose from energy related BITs without discouraging future investors from coming to host countries is possible. In the end, the paper provides an analysis of the arbitration process in energy investment and its implication for Turkey.
