Özet

TBK m. 350 ile 356 hükümleri arasında kira sözleşmesinin dava yoluyla sona ermesine ilişkin hükümler düzenlenmiştir. Yeniden inşa veya imar sebebi ile kira sözleşmesinin sona ermesi de kira sözleşmesinin dava yoluyla sona ermesi sebeplerindendir. TBK m.350/f.2, b.2' ye göre; Kiralananın yeniden inşası veya imarı amacıyla esaslı onarımı, genişletilmesi ya da değiştirilmesi gerekli ve bu işler sırasında kiralananın kullanımı imkânsız ise, belirli süreli sözleşmelerde sürenin sonunda, belirsiz süreli sözleşmelerde kiraya ilişkin genel hükümlere göre fesih dönemine ve fesih bildirimi için öngörülen sürelere uyularak belirlenecek tarihten başlayarak bir ay içinde açacağı dava ile sona erdirebilir". Bu çalışmada TBK m. 350/b. 2/f. 2'de düzenlenen yeniden inşa veya imar sebebiyle sözleşmenin sona ermesi hem Kanun hem de Yargıtay kararları açısından incelenecektir. Bununla birlikte, kentsel dönüşüm sürecinde kiracının tahliyesi bakımından, 6306 sayılı Afet Riski Altındaki Alanların Dönüştürülmesi Hakkında Kanun incelenecektir.

Özet (Çeviri)

Provisions relating to the termination of the lease contract through remedies have been issued between the provisions of Articles 350 and 355 of the Turkish Code of Obligations. The termination of the lease contract due to rebuilding or reconstruction is also one of the reasons for the termination of the lease contract through remedies. According to Article 350 of Turkish Code of Obligations; If it is necessary for substantial restoration, expansion or alteration of the leased object for the purpose of rebuilding or reconstructing, and if it is impossible to use the leased object during such work, it may conclude with a law suit to be filed within one month starting from the date to be determined in accordance with the term of termination and the period prescribed for the notification of termination according to the general provisions on the rental in indefinite period contracts at the end of the fixed-term contracts". In this study, the termination of the contract will be examined both in terms of the decisions of the Law and of the Supreme Court due to rebuilding or reconstruction issued in Article 350 of Turkish Code of Obligations. Besides, the Law on the Conversion of Areas under Disaster Risk No. 6306 in the process of urban transformation will be examined in relation to the evacuation of the tenant and will be explained in comparison with the termination provisions of the lease contract due to rebuilding or reconstruction issued in Article 350 of Turkish Code of Obligations.
