Non-refoulement is a norm that obligates states not to return a person to any territory where he or she is likely to encounter persecution. This rule has emerged under international human rights treaties and domestic asylum law instruments. Despite its willingness to move forward, a legal gap in respect of the principle of non-refoulement in Turkish legal framework, has brought challenges on Turkey's compatibility under international legal standards. Thereby, this dissertation aims to review the principle of non-refoulement under the Turkish legal system and practices in the light of international law. However, Turkey's own idiosyncratic position between emigrate countries to immigrate countries brings along conflict of interests on asylum implications. From this point of view, this dissertation is briefly based on Critical Legal Approach for understanding the contradictions between Turkish legal system and international asylum law. Consequently, this dissertation attempts to provide suggestions on Turkey's compatibility in regard to the principle of non-refoulement.
