Özet
Yaklaşık iki yüz bin yıl önce dünyada var olan insanlık, var olduğu andan bugüne kadar çevre ile iç içe yaşamaktadır. Yaşamın milyarlarca yıl geçmişinin var olmasına rağmen insanlık var olduğu süre içerisinde çevreden düzenli olarak faydalanarak yaşamını devam ettirmiş ve uyum içerisinde olan düzenin bozulmasına sebebiyet vermiştir. Sanayi Devrimi ile başlayan bu durum, kentlere doğru bir göç akımının başlamasıyla ve kentlerdeki sanayileşmeye paralel olarak artan nüfus ile hızla artan bir eğilim göstermiştir. Tüm bu etkenler sebebiyle çevredeki düzen bozulmuş ve çevresel sorunlar ortaya çıkmıştır. Bu sorunlar karşısında insanlık bir takım çalışmalara girişmiştir. Ancak yapılan çalışmaların çevre hakkı doğrultusunda küresel bir boyuta taşınması yaklaşık olarak 1960'lı yıllara denk gelmektedir. Bu yıllarda ülkeler anayasal metinleri içerisine çevre ile ilgili hükümler eklemiş, dünya kamuoyunun dikkatini çekecek çeşitli konferanslar, toplantılar yapılarak, anlaşmalar imzalanmıştır. Türkiye ise çevre hakkı ile dolaylı şekilde olmuş olsa dahi, ilk olarak 1961 Anayasası'nın 49. maddesi ile tanışmıştır. Ardından 1982 Anayasası'nın 56. maddesi ile birlikte diğer hukuki metinler içerisinde de çevre hakkı yer almaya başlamış ve değişen dünya ile birlikte yer almaya devam etmektedir. Türkiye'de mevcut idare sistemi içinde, yereldeki çevrenin korunmasında önemli işlevselliği olan yerel yönetim birimleri, Belediye, İl Özel İdaresi ve Köy' dür. Yerel yönetimler, çevreyi ve çevre hakkını koruma ve geliştirme konusunda, çevre problemlerine temelde müdahale edebilmesi sebebiyle oldukça önem arz etmektedir. Bu çalışmada Türk Mevzuat Sistemi çerçevesinde, yerel yönetimler içerisinde önemli bir konuma sahip olan öncelikle belediyelerin, ardından diğer diğer yerel yönetim birimlerinin çevre hakkını korumada ne gibi görev ve sorumlulukların var olduğu hususu tespit edilerek, bu doğrultuda hangi faaliyetlerin yürütüldüğü incelenmiş ve inceleme sonucunda bu birimlerin çevre hakkını koruma hakkında ne gibi gereksinimleri olduğu konusuna değinilerek, yerel yönetimlerin çevre hakkını korumadaki rolü tespit edilmeye çalışılmıştır.

Humanity, which existed in the world about two hundred thousand years ago, has been intertwined with the environment from the moment that it exists. Despite the existence of billions of years of life, human beings have continued their lives by making use of the environment regularly during the period they existed and caused the disturbance of the system in harmony. This situation, which started with the Industrial Revolution, showed a rapidly increasing trend with the beginning of a migration movement towards the cities and an increasing population parallel to the industrialization in the cities. Due to all these factors, the environment was disturbed and environmental problems arose. In the face of these problems, humanity has started to work. However, the studies carried out towards a global dimension in line with the environmental right almost coincide with the 1960s. In these years, countries have added environmental provisions to their constitutional texts, various conferences, meetings were held to draw the attention of the world public. Turkey, even if it was indirectly, had firstly met environmental right with the 49th article of 1961 Constitution. Then, with the 56th article of the 1982 Constitution, the right to environment has been included in other legal texts and continues to take place together with the changing world. In Turkey, within the current administrative system, local government units that are important functionality in environmental protection at the local, municipal, special provincial administrations and village 'roll. Local governments are very important in terms of protecting and developing the environment and the environment, as they are able to intervene fundamentally to environmental problems. In this study, within the framework of the Turkish Legislation System, it was determined that the duties and responsibilities of the municipalities, and then the other local government units, which have an important position among the local administrations, in order to protect the environmental rights of the municipalities, and what activities were carried out in this direction, and and the role of local governments in protecting the right to environment is mentioned.
