Özet

TC KOCAELİ ÜNİVERSİTESİ SOSYAL BİLİMLER ENSTİTÜSÜ ÖZEL HUKUK BÖLÜMÜ TEZ ÖZETİ ÇEVRESEL ETKİ DE?ERLENDİRMESİ Çevre sorunları sanayileşme olgusunun çok fazla önem kazandığı son çeyrek yüzyıllık dilimde ön plana çıkmıştır. Ekolojik dengeyi bozmadan bütüncü bir gelişme asıldır. Bu amaca yönelik olarak çeşitli çevre politikaları ortaya çıkmıştır. Geliştirilen yöntemlerden biri de“Çevresel Etki Değerlendirmesi (ÇED)”dir. Bu yöntem çevre üzerinde ortaya çıkabilecek olumsuz etkileri daha baştan belirleyebilmek için gerekli önlemleri tespit etmek amacıyla geliştirilmiştir. ÇED'in hukuki boyutu konulu yüksek lisans tezinde önce ÇED'in uluslararası alandaki yapılanma biçimi, çeşitli belgelerdeki görünümü ve bu uluslararası alandaki normların bağlayıcı gücü ortaya kondu. Karşılaştırmalı hukukta ÇED ile ilgili uygulamalar ve hukuki dayanaklara kısaca değinildikten sonra, Türk Hukukundaki ÇED süreci irdelendi. Bu yapılırken ÇED'in dayanağını aldığı anayasal, yasal ve yönetsel düzenlemeler ortaya kondu ve bu çerçevede ÇED yükümlülüğüne aykırılığın farklı hukuk disiplinlerinde doğuracağı sorumluluk incelendi. Bu sistematik içinde yapılan çalışma sonucunda ortaya çıkan şu ki; ÇED, etkin bir biçimde uygulandığında, sağlıklı bir çevrede yaşama hakkı gerçek anlamını kazanabilecektir. Bu etkin uygulamanın gerçekleştirilmesinde ise en önemli rolü hukukun oynayacağı açıktır. Bizde ÇED, uygulamalarla değil, mevzuatla kurulmuş ve geliştirilmiş bir yöntemdir. Bu sebeple bizde, ÇED'in etkili hale getirilmesi konusunda da hukuk ön plana çıkmaktadır. Bu da ağırlıklı olarak iki alanda kendini gösterecek, uygulamadaki etkinliğin sağlanması ile de sistem tamamlanacaktır. Ancak, uygulamadaki etkinliğin derecesi de yine bu alanda sorumluluk ve yaptırıma ilişkin normların korkutuculuğuyla doğru orantılı olacaktır. Eski ve yeni, her iki ÇED yönetmeliğinde de merkeziyetçi zihniyet ve sürdürülebilir kalkınma yerine, ekonomik kalkınmayı esas alan düşünce hakimdir. TC KOCAELİ UNIVERSITY INSTITUTE OF SOCIAL SCIENCES PRIVATE LAW DEPARTMENT SUMMARY OF THE THESIS ENVIRONMENTAL IMPACT ASSESSMENT During the last three decades, in which there is a growing importance of industralization, environmental problems have increased. It is essential that an integral development be provided without denegenerating the ecological balance. Owing to this objective, various environmental policies which hold different measures have occurred. One of these measures is Environmental Impact Assessment (EIA). EIA is suggested in order to ascertain the preventive measures before possible damages happen. In this thesis, first, the process of EIA in internetional area, its different aspects in some international documents and binding effort of these international rules are explained. Second, having stated the regulations and the practises of EIA shortly, the process of EIA in Turkish Law is assessed. During this, the constitutional, legal and administrative regulations are explained and in tis framework the liability which the violations of the EIA process could cause in different diciplines is studied. According to the systematic of this study, it is obvious that if EIA is applied effectively, the right to live in a healthy environment will have its real meaning. It is also clear that the law plays the crucial role for realizing efficient practises. In our country EIA was established and has been developed by the positive law, not by practises but the law also plays the crucial role in Turkey. This will appear in two ways and the system will be accomplished by providing the efficiency of the practises. However the degree of efficiency will also have a ratio with the liability and enforcement which are stated by the law. In both Turkish EIA statutes, the old and the new, the central mentality and the approach which gives importance to the economical development rather than the sustainable development are dominant.
