Özet
İnsanların bir arada huzur ve güven içerisinde yaşaması için şüphesiz sağlıklı bir kamu düzenine ihtiyaç vardır. Bu amaçla en ilkelinden en modernine kadar bütün toplumlar kamu düzenini tesis etmek için çeşitli kanuni düzenlemeler yaparak bir hukuk sistemi oluşturmaya çalışmışlardır. Bireylerin hak ve hukukuna riayet eden, kimseyi ötekileştirmeyen adil bir kamu düzeni tesis eden toplumların oluşturduğu devlet yapıları bu vasıflarını korudukları sürece yaşama imkanı bulmuşlar, adalet kurumu zaafa uğramaya başlayınca kamu düzeni bozulmuş, huzurun yerini kargaşa ve kaos alarak devletleri yıkılışa sürüklemiştir. Bu yönüyle genelde toplum özelde insan hayatı için son derece önemli bir yeri olan adalet kurumu edebî eserlerin vazgeçilmez temalarından birini oluşturmuştur. Bir yönüyle kolektif şuurun aktarıcısı olan bu eserler, üretildikleri tarihten sonra toplumun geçmişini yansıtan sosyolojik veri niteliği kazanarak geleceğin inşasında istifade edilecek kaynaklar arasına girmiştir. Doktora tezi çalışması kapsamında tespit edilebildiği kadarıyla Atatürk Dönemi'nde yazılan 418 romandan 161 tanesi okunmuş ve 33 yazara ait 96 roman tez içerisinde kullanılmıştır. Giriş ve Sonuç dışında10 bölümden oluşan bu çalışmada Türk milletinin I. Meşrutiyet, II. Meşrutiyet ve Atatürk dönemleri adalet algısı, adalet kurumuna bakışı, devrin hukukî mevzuatının toplumda nasıl yankı bulduğu gibi hususlar tarihî gerçeklikle ilişkisi sorgulanarak tespit edilmeye çalışılmıştır. Böylece bir dönemin tarihî, antropolojik, arkeolojik bilgi ve bulgularıyla tespit edilemeyen tecrübî yaşantısı sunularak adalet kurumunun şekillenmesinde yararlı olacağı düşünülen yeni istifade olanakları oluşturulmaya çalışılmıştır.

ABSTRACT There is no doubt a healthy public order is needed for people to live together in peace and security. For this purpose, all societies from the most primitive to the most modern have tried to create a legal system by making various legal arrangements to establish public order. The state structures formed by societies that observe the rights and laws of individuals and establish a just public order that does not otherize anyone have the opportunity to live as long as they maintain these qualities, when the Justice institution began to suffer from weakness, public order was corrupted, peace was replaced by turmoil and chaos and brought the states into collapse. In this respect, the Justice institution, which has a very important place generally in society especially for human life, has formed one of the indispensable themes of literary works. These works, in some way the transponder of collective consciousness, have become a source of sociological data reflecting the history of society after the date they were produced and have become among the sources to be used in the construction of the future. As far as it can be determined within the scope of the doctoral thesis study, 161 of the 418 novels written in the period of Atatürk have been read and 96 novels belonging to 33 authors have been used in this thesis. In this study, which consists of ten parts except introduction and conclusion, the First Constitutional monarchy, second Constitutional monarchy of the Turkish Nation, and Atatürk Periods, the issues such as the perception of justice, the view of the justice institution, how the legal legislation of the period resonated in the society were tried to be determined by questioning their relationship with the historical reality. Thereby, by presenting the historical, anthropological and archaeological knowledge of a period and the experience that cannot be determined by its findings, it was tried to create new opportunities for exploitation, which are thought to be beneficial in shaping the justice institution.
