Özet
Müslüman bir mükellefin dünya ve ahiret mutluluğunu elde edebilmesi için bilmesi gereken“emirler”ve“nehiyler”, fıkıh usûlü eserlerinde gerek dünya ve gerekse ahiret hayatı açısından ele alınmaktadır. Zira bu konular, kişinin hem bireysel davranışlarını, hem de diğer insanlarla ilişkilerini düzenlemesi bakımından dünya hayatını ilişkindir. Aynı zamanda kişinin mükâfatı elde etmesi/cezayı hak etmesi bakımından da ahiret hayatını ilgilendirmektedir. Bu çalışmamız, söz konusu iki kavramdan biri olan“nehy”in delâleti ve furû fıkha dair yansımalarını, Hanefî ve Şâfiî mezhepleri örnekliğinde konu edinmektedir. Nehyin delâleti meselesi, İslam'ın ilk dönemlerinden itibaren işlenen konu olması nedeniyle, çalışmamızda, bu konu, fıkıh usûlü alanında tedvin edilmiş ilk eserlerden itibaren ele alınmaktadır. Ayrıca mezheplerin temel görüşlerini yansıtması bakımından, söz konusu mezheplerde önemli yere sahip İslam hukukçularının konuya ilişkin görüşleri incelenmektedir. Çalışmamızın birinci bölümünde nehiy kavramı tanımlanmakta ve nehiyle ilgili bazı meseleler kısaca ele alınmaktadır. İkinci bölümde Hanefî ve Şâfiî mezheplerine mensup İslam hukukçularının nehyin delâleti konusundaki görüşleri sunulmaktadır. Üçüncü bölümde ise, çalışmamız furû fıkıh alanından verilen örnekler bağlamında, Hanefî ve Şâfiî mezhebine mensup İslam hukukçularının benimsedikleri görüşler ile tatbik edilen furû fıkıh arasında uyumun var olup olmadığını konu edinmektedir.

In order to achieve the happiness of in the world and the hereafter (Judgement),“commandments (amr)”and“prohibitons (nahy)”, that a Muslim mukallaf should know are handled in terms of both the world and the hereafter (Judgement) life. Because these issues are related to the world life in terms of organizing both individual behavior and relationships with other people. At the same time in terms of obtaining reward/deserving punishment, they concern the hereafter (Judgement) life. This study focuses on the signification of nahy which is one of the two concepts in question, and its reflections on furu' fiqh, in the example of Hanafi and Shafi'i madhabs. Since the issue of the nahy's signification is the subject that has been studied since the early periods of Islam, in our study, this issue is handled from the first works in the field of usul al-fiqh. In addition, in terms of it reflects the basic views of the madhabs, the views on the subject, of Islamic jurists who have an important position in these madhabs are examined. In the first part of our study, the concept of nahy is defined and some issues related to it are briefly handled. In the second part, the views of Islamic jurists of Hanafi and Shafi'i madhabs about nahy's signification are presented. In the third part, our study, in the context of examples given from the field of furu' fiqh, focuses on whether there is a harmony between the views of Islamic jurists belonging to Hanafi and Shafi'i madhabs and the applied furu' fiqh.
