As a result of developments in technology, globalization has affected every aspect of life including the means of trade which increased international business. In this aspect, shipping has become an important transportation method for the goods bought and sold in the overseas trade. Since English law is one of the most frequently used governing laws in international charterparty transactions, this dissertation focuses on“safe port warranty”obligation of the English shipping law imposed upon the charterer in voyage and time charters by setting out the legal reasons behind this obligation, analyzing in detail its scope and extent and interpretations adopted throughout its usage as expressed and implied terms. Then the study achieves to sort out the issue of whether this allocation of risk on the charterer regarding safe port warranty is allocated fairly in terms of ability to eliminate risk on the part of the shipowner in respect of current technological developments in the maritime industry as well as within the framework of international rules; the International Safety Management Code (ISM Code) and International Ship and Port Facility Security Code (ISPS Code) set out by the UN's International Maritime Organization in order to assure safety at the ports.
