Özet
Birçok ekibin ve organizasyonun bir araya gelmesiyle yürütülen inşaat projelerindeki temel amaç en uygun maliyetle, belirlenen sürede kaliteli bir eser ortaya çıkarabilmektir. Bu amacın gerçekleştirilebilmesi için, öncelikle projenin ihtiyaçlarının ne olduğu ve nasıl karşılanacağı açık bir şekilde ortaya konmalı, buna bağlı olarak projenin parçalarını oluşturan tarafların kapasiteleri iyi tespit edilmeli ve uygun bir sözleşme zemininde bir araya gelmesi sağlanmalıdır. İnşaat projelerinin başlangıcından teslimine kadarki süreç içerisinde tarafların ilişkilerinin ve takip etmesi gereken adım ve uygulamaların belirlendiği ihaleler, şartnameler ve inşaat sözleşmeleri, sektördeki en önemli unsurları oluşturmaktadır. Gerek projelerin kapsamına gerekse tarafların özelliklerine göre farklı içeriklere sahip olabilecek ihale ve sözleşmeler, günümüzde üzerinde daha fazla özen gösterilmesi gereken bir konu haline gelmiştir. Ülkemizde kimi zaman ihalelerdeki hatalardan, sözleşme uygunsuzluğundan veya sözleşmeler ile şartnamelerin bazı durumlarda eksik kalmasından dolayı projeler istenilen süre, bütçe ve kalitede tamamlanamamaktadır. Türkiye'de özellikle son yıllardaki projelerde, yükleniciler ile taşeronların yeterliğinin tespit edilemediği, uygun sözleşme zeminin oluşturulamadığı ve anlaşmazlıkların çözümünde zorluklar yaşandığı görülmüş, buna bağlı olarak Avrupa Birliği çalışmalarının da etkisiyle, 4734 sayılı Kamu İhale Kanunu, 4735 sayılı Kamu İhale Sözleşmeleri Kanunu, Yapım İşleri Uygulama Yönetmeliği gibi düzenlemeler yapılmıştır. Yine bu sebeple özellikle kamu yapım işlerinde standart sözleşme dokümanları kullanılmakta, FIDIC uygulamalarından yararlanmaya çalışılmaktadır. Ancak bu düzenlemelerin de sorunları çözmekte kimi zaman yetersiz kaldığı görülmektedir. Bu çalışmanın ilk üç kısmında yapılan literatür taramasından elde edilen bilgiler ışığında, Türkiye'deki inşaat projelerinde katılımcıların özelliklerine göre farklılaşan proje teslim türlerine, ihalelere, yüklenici seçim aşamaları ile kıstaslarına değinilecektir. Ayrıca ülkemiz inşaat sektöründe kullanılan mevzuat, Yapım İşleri Genel Şartnamesi ve sözleşme tipleri ile FIDIC şartname ve sözleşmeleri incelenecek, bu çerçevede ihale ve sözleşme yönetimi kavramı da genel hatlarıyla ele alınacaktır. Daha sonraki bölümlerde ise, yapılan anket çalışması kapsamında sektördeki yüklenici ve işveren firma/kurumlar ile uzmanlardan gelen cevaplara göre, Türkiye yapı sektöründeki yüklenici seçimi, sözleşme tipleri ve kullanılan şartnamelerin proje yönetim sürecine etkilerine ışık tutulmaya çalışılacak ve bu süreçte yaşanan problemlerin çözümü için çeşitli önerilerde bulunulacaktır.

Main object of construction projects is to create a high quality work in a certain time and with an optimum cost. To achieve this, first of all, the needs of the project and how to be fulfilled should be clearly defined, the capacities of the parties that forms the project participants should be determined well and it should be ensured they meet on an appropriate contract ground. In the construction sector, tenders, specifications (i.e. conditions) and contracts in which the relations of the parties and the steps and implementations to be followed are determined during the process from the beginning to the delivery of construction projects are one of the most important elements. Tenders and contracts, which may have different contents depending on the scope of the projects and the qualities of the parties, have become an issue that needs to be paid more attention today. In our country, sometimes the projects cannot be completed in the desired period, budget and quality due to errors in tenders, nonsuitability of contracts or the inadequacy of contracts and specifications in some cases. Especially in recent years, it has been seen qualifications of contractors and subcontractors could not be detected well, proper contract ground could not be constituted and difficulties in dispute resolution took place. In parallel with this, Turkish government has make arrangement such as law no: 4734-4375 Public Procurement&Contracts Law, Construction Works Application Regulations on effect of European Union studies. Moreover, standard contract documents are used especially in public works and it is tried to make use of FIDIC practices but this does not seem to solve the problems completely. In the first three part of this study, in the light of information obtained from the literature review, project delivery methods and tenders that differs with the qualifications of the participants, contractor selection stages and criterias in Turkey's construction projects will be mentioned. In addition, regulations, General Conditions for the Construction Works, types of the contracts used in the Turkish construction sector and FIDIC specifications (conditions) and contracts will be examined. Within this framework, the concept of tender and contract management will be briefly discussed. In the other parts, within the scope of the survey study, based on the answers from contractors, employers and experts, it will be attempted to shed light on the effects of selection of contractor, contract and specification types on construction project management in Turkish construction sector. Therefore, for the various problems encountered on this subject, several solution suggestions will be offered at the end.
