Özet

ÖZET Son yıllarda ülkemizin gündeminde çevre problemleri önemli bir yer tutmaktadır. Gün olmuyor ki, hava kirliliği, sel felaketi, toprak kayması gibi haberler duyulmasın. Sayılan bu sorunlarda, ormanlarımızın gün geçtikçe yok olması en aktif role sahiptir. Ülkemiz coğrafi konum olarak Dünya çöl kuşağının kenarındadır. Dolayısıyla mevcut şartların sağlanması durumunda hızla çölleşmeye mahkum olacaktır. Bu yüzden ormanlarımızın en iyi şekilde korunması gereklidir. Korumanın en önemli şartı ise orman sınırlarının tespit edilerek kadastrosunun tamamlanmasıdır. 1937 yılından beri orman tahdit ve kadastro çalışmaları yürütülmektedir ve ne yazık ki bu süre zarfinda sadece %70'inin kadastrosu tamamlanabilmiştir. Bu çalışmanın amacı, orman kadastrosundaki başarısızlığın hukuki ve idari boyutunu ortaya koymaktır. Bu amaçla, geçmişten günümüze orman kadastro mevzuatı incelenmiştir. Bunun yanısıra Artvin ili baz alınarak kadastro çalışmalarındaki itirazların boyutu incelenmiştir. Yapılan çalışmalar sonucunda, orman kadastrosunun kısa sürede ve hassasiyetle bitirilebilmesi için ilk tesis kadastrosu bitirilinceye kadar aplikasyon çalışmalarının askıya alınması ve orman kadastro çahşmalarının teknik boyutunun Harita Mühendisi tarafindan yapılması önerilmektedir.

SUMMARY In the last few years, environihental problems have seriously been on the agenda of Türkiye. Seldom do we have the peaceful days free from air pollution, flood and erosion. Of course, among the most important causes for the problems mentioned above is that of the considerable decrase in the amount of the area covered with forest. As we know, our country is located just near the World desert line. Due to this fact, we will soon be challanged by the rapid spread of deserted areas in very near future. That is why, some urgent precotions must be taken to protect the planted areas in the best way. The first thing to sustain this is to complete of cadastre by determining the certain borders of forested areas. In Türkiye, cadastral surveys and studies have been held since 1937 and unfortunately only 70% of forest cadastre have been completed in such a long time. The aim of this study, is to put forward the failure in forest cadastre in respect to both legal defiencies and administrative dimensions. For this reason, all the documents of cadastry up to now have been searched through. Besides, a detailed survey has just been held in Artvin which was chosen as the main place to develop on ideal about the refusals to the cadastral studies. The results reveal that aplication surveys should be cancelled till the first proper cadastral survey will be gone through and that the technical basis of the matter should be established by surveying engineers in order to finish forest cadastre in the shortest tune needed with the best results.
