Özet
Rekabet ve regülasyon çalışmaları, modern dünyada etki alanı geniş bir kavram olarak göze çarpmaktadır. Bu çalışmadaki ilk makale bu kavramı teorik bir çerçevede ele almakla birlikte kendi içerisinde toplu bir kaynak taraması yoluyla literatüre katkı sağlarken, aynı zamanda sonraki iki ampirik çalışmanın da temelini oluşturmaktadır. Çalışmanın ikinci makalesi bir regülasyon olarak AİHM (Avrupa İnsan Hakları Mahkemesi) Büyük Daire kararlarının politik, demografik ve ekonomik parametrelerle olan ilişkisini ortaya koymaktadır. Bu konuda bazı ülkelerin kendi üst yargı mercileri ile ilgili olarak yapılmış olan çalışmalara rastlanmış olsa dahi AİHM düzeyinde yüksek kriterleri olan bir mahkemeyle ilgili bu yönde yapılmış bir çalışmaya rastlanmamıştır. Bu yönüyle söz konusu makalenin, insan davranışlarının başta ekonomik olmak üzere bir kısım farklı parametrelerle olan ilişkisinin makine öğrenmesi algoritmaları ve büyük veri işleme yöntemleri kullanılarak analiz edilmesinin literatüre özgün bir katkı sağlayacağı ifade edilebilir. Bu analiz, tamamen istatistiki bir değerlendirme süreci sonucunda seçilen modeller vasıtasıyla gerçekleştirilmiştir. Bu şekilde bir regülasyon olarak AİHS (Avrupa İnsan Hakları Sözleşmesi) değerlendirilmiş ve uygulama performansı hakkında önemli sonuçlar elde edilmiştir. Tezin son makalesinde ise AB (Avrupa Birliği) üyelerinin aralarında gerçekleştirdikleri ticaret rakamları üzerinden ampirik bir analiz gerçekleştirilmiştir. Dış ticaret çerçevesinde ülkelerin kurduğu ekonomik birlikler faktör kullanımını optimize edebilecek yegâne kurumlardır. Avrupa Birliği kurumsal yapısı, üyeleriyle olan ilişkileri ve ekonomik potansiyeli itibariyle önde gelen bir bölgesel entegrasyondur. Birliğe üyeliğin ve Avrupa Para Birliğine dâhil olmanın literatürle uyumlu temel ekonomik değişkenlerle desteklendiği modelde, dikkate alınan değişkenlerin Avrupa Birliğine üye olan ülkelerin kendi içerisindeki dış ticaretlerine olan etkisi, ithalat ve ihracat rakamları çerçevesinde analiz edilmiştir. Analiz öncesinde çalışmanın teorik temelini oluşturmak adına klasik ve yeni akım dış ticaret teorilerinden bahsedilmiştir. Elde edilen sonuçlar üst seviye kurumsal yapıları oluşturun regülasyonların amaç ve sonuç ilişkisini ortaya koyması noktasında önemlidir. Literatürde dış ticaret rakamlarının temel ekonomik değişkenler ile olan ilişkisini araştıran çalışmalar bulunmakla birlikte konuyu kurumsal çerçevede regülasyonlarla ilişkilendiren analizlere rastlanmamıştır.

Competition and regulation studies and researches stand out as a wide-ranging concept in the modern world. While the first article in this study contributes to the literature through a collective literature review by addressing this concept in a theoretical framework, it also forms the basis of the next two ampirical studies. The second article of the study reveals the relationship between the decisions of the ECHR Grand Chamber as a regulation and political, demographic and economic parameters. Even though some studies on this issue related to the higher judicial authorities of some countries have been found, there has been no study in this direction regarding a court with high criteria at the ECHR level. In this respect, the article in question made a unique contribution to the literature by analyzing the relationship of human behavior with some different parameters, especially economic, using machine learning algorithms and big data processing methods. This analysis was carried out through models selected as a result of a purely statistical evaluation process. In this way, Convention of Human Rights was evaluated as a regulation and important results were obtained about application performance. In the last article of our study, an empirical analysis was carried out on the foreign trade figures of EU members. Economic cooperation established by countries within the framework of foreign trade are the only institutions that can optimize the use of factor. The European Union is a prominent community in terms of its institutional structure, relations with its members and economic potential. In our model, where membership to the European Union and being included in the European Monetary Union is supported by basic economic variables compatible with the literature, the effect of the variables in the model on the foreign trade of the European Union member countries is analyzed within the framework of import and export figures. Before the analysis, classical and new current foreign trade theories were mentioned in order to form the theoretical basis of the study. The results obtained are important in terms of establishing high-level corporate structures and revealing the relationship of purpose and result of regulations. Although there are studies investigating the relationship between foreign trade figures and basic economic variables in the literature, there are no empirical analyzes that reveal its relationship with regulations in the institutional framework, and a unique contribution has been made to the literature in this respect.
