Özet
Globalleşen ve büyüyen ekonomi neticesinde anonim şirketler ile şirket içerisindeki pay sahipleri sayısı da doğru orantılı olarak artmıştır. Pay sahiplerinin artması şirket içerisinde meydana gelen menfaat ihtilaflarını da beraberinde getirmiştir. Bu menfaat ihtilaflarını bertaraf etmek için ortaklıktan çıkarılma sonucunu doğuran kanun hükümlerine yer verilmesi zorunluluğu meydana gelmiştir. 6102 Sayılı Türk Ticaret Kanunu'nda pay sahipliği sıfatını sonlandıran kanun hükümlerine yer verilmesiyle bu zorunluluk giderilmiştir.

As a result of the globalizing and growing economy, the number of joint stock companies increased. With the growth of companies, the number of shareholders within the company increased. The increase in the shareholders has brought about the conflicts of interest within the company. In order to eliminate these conflicts of interest, the provisions of the law resulting from the expulsion from the partnership have been obliged to be included. The regulations regarding the removal from the partnership have been made more effective by the Turkish Commercial Code No. 6102.
