Özet
Günümüz şartlarında demokrasi türlerinden en işlevseli temsili demokrasi olup temsili demokrasinin vazgeçilmez unsuru ise siyasi partilerdir. Siyasi partilerin kurumsal hüviyete bürünmesi ve demokratik nitelik taşıyabilmesi de seçimler marifetiyle ortaya çıkmakta ve temsilciler düzenli aralıklarla yapılan seçimlerle belirlenmektedir. Seçim sistemleri, temsilde adalet ve yönetimde istikrar ilkelerinden birine ağırlık verirler. Yönetimde istikrar ilkesine ağırlık veren ülkeler çoğunluk sistemi, temsilde adalet sistemi ilkesine ağırlık veren ülkeler nispi temsil sistemi, her ikisini kullanmayı amaçlayan ülkeler ise karma seçim sistemlerini kullanmaktadır. Demokrasiyle yönetilen ülkelerde, seçim dışında diğer önemli bir unsur ise ülkelerin hükümet sistemleridir. Kuvvetlerin birbirinden ayrılma düzeyi üzerinden şekillenen hükümet sistemleri, demokrasinin işleyişini etkilemektedir. Türkiye hükümet sistemleri ve seçim sistemleri açısından farklı deneyimlere sahip durumdadır. Günümüzde uygulanan yeni hükümet sisteminin demokrasi, seçim ve hükümet sistemleri çerçevesinde analiz edilmesi, sistemin geleceği açısından önemlidir. Bu kapsamda çalışmanın birinci bölümünde demokrasinin rehberliğinde seçme hakkı ve yöntemleri, seçim sistemleri ve hükümet sistemlerinin tanımlamaları, tarihsellikleri, özellikleri ve değerlendirmeleri yapılarak tüm yönleriyle ele alınmıştır. İkinci bölümde ise Türk anayasalarında“1876 Kanun-u Esasi”den başlanarak, günümüze kadar yapılan anayasal değişiklikler bağlamında hükümet sistemleri ve tüm seçimler ayrıntılı bir şekilde anlatılmıştır. Özellikle 2007-2017 Anayasa değişiklikleriyle birlikte Türk Tipi Başkanlık sistemine yönelik değişiklikler ve değerlendirmeler yapılmıştır. Çalışmanın sonunda Türk Tipi Başkanlık sistemine yönelik sivil anayasa yapımı çalışmaları kapsamında sistemde yaşanabilecek tıkanıklıkların, krizlerin ve çatışmaların önüne geçilebilmesi yasama, yürütme ve yargı organları arasında denge denetim mekanizmanın kurulabilmesine yönelik öneriler sunulmaktadır.

In today's conditions, the most functional type of democracy is representative democracy, and the indispensable element of representative democracy is political parties. The institutionalization and democratic nature of political parties is also revealed through elections, and representatives are determined through elections held at regular intervals. Electoral systems give weight to one of the principles of fairness in representation and stability in administration. Countries that emphasize the principle of stability in administration use majority system, countries that emphasize the principle of justice system in representation use proportional representation system, countries that aim to use both use mixed electoral systems. In countries governed by democracy, another important element other than elections is the government systems of the countries. Government systems shaped by the level of separation of powers affect the functioning of democracy. Turkey has different experiences in terms of government systems and electoral systems. Analyzing the new government system implemented today within the framework of democracy, election and government systems is important for the future of the system. In this context, in the first part of the study, the right to vote and its methods, electoral systems and government systems, their historicity, characteristics and evaluations are discussed in all aspects under the guidance of democracy. In the second part, starting from the“1876 Kanun-u Esasi”in Turkish constitutions, government systems and all elections are explained in detail in the context of the constitutional changes made until today. Especially with the 2007-2017 Constitutional amendments, changes and evaluations were made regarding the Turkish Type Presidency System. At the end of the study, within the scope of the civil constitution making studies for the Turkish Type Presidential system, suggestions are presented to prevent the bottlenecks, crises and conflicts that may occur in the system and to establish a balance control mechanism between the legislative, executive and judicial organs.
