This dissertation considers the freedom of movement (free movement) rights of Turkish citizens in the European Union (EU). Under EU law, there are four fundamental freedoms, free movement of persons, free movement of services, free movement of goods and free movement of capital. These freedoms are guaranteed under Treaty on the Functioning of the EU (TFEU) for EU citizens. However, the EU has the competence to sign association agreements with third countries. Turkey is one of these third countries, which signed the Ankara Agreement (AA) with the EU in 1963. The AA, which entered into force in 1964, governs the association between Turkey and the EU, and it specifies the principles of the association. Regarding the historical chronology of the relations, the parties signed the Additional Protocol (AP) in 1970. Heeding Turkey's European integration endeavors, the Association Council (AC) Decisions, such as Decision 1/80, were signed afterwards. Although the customs union between the parties (AC Decision 1/95) initiated the last stage of the association, the parties aimed to embark on a quest to find mutual responses against regional and global problems. The Visa Liberalization Dialogue (VLD) in parallel with the objective of preventing irregular migration, was one of these responses. The parties initiated the VLD in 2013. Currently, the political and legal findings indicate that the EU-Turkey relations are in a deadlock. In consideration with its everlasting outcomes, this dissertation will argue that the freedom of movement rights of Turkish citizens in the EU were jeopardized due to the legally baseless and asymmetrical interpretations of the EU-Turkey Association Law. Mainly, the primacy of the EU-Turkey Association Law over secondary legislation will be emphasized in order to facilitate the enforcement of the rights. Meanwhile, this paper will also lay stress on the necessity of finding a coherent Court of Justice of the EU (ECJ/ Court) jurisprudence.
