Millions of migrants attempted to cross the Mediterranean Sea to reach the EU borders, hoping for a better life for themselves. Thousands of them were missing or dead in those dangerous journeys, and those who landed were accumulating in the Mediterranean states of the EU, mostly with the help of human traffickers and smugglers. The Union could not stay silent on the migration crisis and to fight against irregular migration, human traffickers and smugglers, used CFSP tools as leverage and launched a CSDP mission of EUNAVFOR MED – Operation Sophia in 2015. Operation Sophia encountered many challenges from the beginning. It was established as a naval operation involving territorial seas, where the Union had lack of experience and required consent of the Libyan authorities and a UN Security Council Resolution. After tackling these problems, the operation then faced the issues over the protection and relocation of the migrants. The operation“rescued”migrants by sending them back to their departure points of unsafe places such as Libya, where they were exposed to human right violations and inhumane treatment. The search and rescue activities related to the operation gradually disappeared and were left to the Libyan Coastal Guards. Since the people who were saved in the operations created a more significant problem among the Member States with their disembarkation, the EU's journey on coping with the migration crisis shifted from saving lives to curbing migration and closing the doors for the people. Therefore, the EU neglected its responsibilities of human rights and international law and the outcome of Operation Sophia constituted incompatibilities with the Union's migration law and policy.
