This dissertation focuses on characterictics and trade-offs of fast-track arbitration from critical perspective to find ideal balance between speed and quality in the procedure.While it clarifies the role of the distinctive limitations in fast-track proceeding, potential problems arising from stringent of the procedure are also evaluated. Mainly, this dissertation examines five fundamental characteristics: application, appointment of arbitator,sumbission of document, hearing and award. Under sub-sections, importance of each characteristics are considered, providing wide range of solution for potential difficulties and negative outcomes. The study has two key arguments.First, even though fast-track arbitration aim at expedited dispute resolution process, other objectives of the arbitration should not be sacrificed to ensure integrity and efficiency of the procedure and award.Second, as opposed to common views of majority, fast-track arbitration rules can be applicable to wide range of disputes, regardless of complexity or value of the dispute.However, it requires exhaustive efforts to make the fast-track procedure more timely-eficient and flawless. From critical point of view, this dissertation attempts to proposes reliable and practical suggestions and solutions to make the fast-track arbitration more convenient and preferable for future disputes.On the other hand, considerations point out some external factors that should be taken account by the arbitrator and the parties to prevent unpredictable outcomes. The study concludes that fast-track arbitration has potential to be commonly-used in the near future.
