Turkish construction law has evolved parallel to the developments in the international construction arbitration and has overcome certain deficiencies over the years. Nevertheless, Turkish construction law still has issues and drawbacks that need to remedied to allow for a more functional arbitration environment. In principle, Turkish arbitration law is still a novel field that is open to further development. Therefore, it includes certain juridical deficiencies which are reflected in the field of construction arbitration. Courts in Turkey are not specialized in arbitration yet, which creates problematic approaches in construction arbitration. Furthermore, there are person-based deficiencies, including the ones related to the arbitral tribunal, its structure, and qualifications. In this dissertation, these issues are probed in detail, and solutions are proposed in the form of separation of construction arbitration rules, revisions and amendments. Moreover, improvement of terminology, specialization of courts in arbitration, and specified arbitration guidelines on construction disputes in the Turkish construction arbitration law are proposed as remedies to the three main categories of problems. On balance, this work reviews arbitration and construction arbitration law of Turkey, identifies the problems, and proposes solutions to them.
