The nuclear energy sector and investments in the sector are relatively new. Investors did not invest for a long time in this sector, which is crucial to security. With the change of host state' attitude towards investors in the sector, investors entered in the sector and the possibility of disputes also emerged. Energy Charter Treaty (ECT) provides an effective mechanism to protect foreign investments in the energy sector against particularly non-commercial risks. Considering the pros and cons of nuclear energy together, it is seen that whether to invest in the sector is a political decision. If a state joins the nuclear power sector, the host state must respect the rights of investors protected by international law, ECT and, if applicable, BIT. Public health, safety or environmental measures by the state may be perceived as indirect expropriation by foreign investors. Uncertainties in the legislation may cause foreign investors to hesitate to invest in the nuclear energy sector. One of the purposes of the dissertation is what legal problems might arise in the context of nuclear energy disputes. The paper explains the emergence of ECT and discuss the treaty. It also includes studies of nuclear energy related disputes that arise under ECT. On the later part, the issues of jurisdiction and acceptability, whether the phasing out of nuclear power would violate fair and equitable treatment and unlawful expropriation are discussed.
