The relationship between environmental law and human rights is accepted at the international level. Hence, the right to environment became one of the most debatable rights in doctrine and practice. However, the right to environment as a standalone right is not recognised in a binding global instrument yet. Albeit the absence of a substantive universal right to environment, numerous developments gave the feeling that the right will be recognised soon. Particularly, the recognition of the human right to water and sanitation under the United Nations, the establishment of a mandate on human rights and the environment under the United Nations and the initiative for Global Pact for the Environment indicated that it is the time for an independent right to environment. In addition, many regional systems for human rights developed parallel with universal initiatives. Meanwhile, many problems arising from domestic level and global threats such as climate change accelerated the discussions for the right to environment. Thus, the need for a global independent right to environment arise. In this context, the requirement of an independent right to environment at the international level will be examined in light of these discussions and problems in this LL.M. paper.
