Özet
İstiklal Mahkemelerinin faaliyet gösterdiği dönemin üzerinden 100 yıla yakın bir zaman geçmiş olmasına rağmen günümüz Türkiye Cumhuriyeti tarihinin en çok tartışılan konularının arasında İstiklal Mahkemeleri ve bu mahkemelerin çalışmaları vardır. Bu tartışmanın en büyük sebeplerinden biri, konunun yeterince incelenip açığa kavuşturulmamış olmasındandır. Oysa bu konu tarih, siyaset, sosyoloji, hukuk, psikoloji alanlarıyla yakından ilişkilidir ve üzerinde araştırmalar yapılmasını gerektirir. TBMM ve Başbakanlık Arşivleri, ATASE, Nutuk, gazeteler ve dergiler konu hakkında başvurulabilecek resmi kaynaklardır. Yapılan çalışmaların daha çok kişisel hatıratların yayınlanması şeklinde veya kulaktan dolma bilgilerle ortaya atılan iddialar olmasından dolayı bu konu objektif bir şekilde üzerinde durulması gereken önemli konulardandır. Bu çalışmada; İstiklal Mahkemeleri'nin Isparta'daki ve mahkemenin çalışma alanı kapsamına giren çevre bölgelerdeki faaliyetleri değerlendirilecektir. Tez çalışması toplamda üç ana bölümden oluşmaktadır. Birinci bölüm kendi içerisinde dört kısımdan oluşmaktadır. İlk kısımda Hıyanet-i Vataniye Kanunu ve uygulanması, ikinci kısımda İstiklal Mahkemeleri ve bu mahkemelerin kuruluş nedenleri, üçüncü kısımda İstiklal Mahkemelerinin baktığı davalar incelenirken son kısımda İstiklal Mahkemeleri'nin kapatılmasına değinilecektir. İkinci bölüm kendi içerisinde üç kısımdan oluşmaktadır. İlk kısımda Isparta'nın İtalyan işgali karşısında göstermiş olduğu direniş faaliyetleri ve sonuçları incelenirken, ikinci kısımda Isparta'nın Milli Mücadele'ye katkısında büyük payı olan Hafız İbrahim Demiralay ve faaliyetleri hakkında bilgi verilmiştir. Üçüncü kısımda ise Ege Bölgesi'nin düşman işgaline karşı direnişinde büyük katkısı olan Kuvâ-yı Milliye şeflerinden Demirci Mehmet Efe'nin Isparta ve çevresinin direnişine verdiği destekten bahsedilmiştir. Üçüncü bölüm ise, kendi içerisinde dört bölümden oluşmaktadır. İlk üç bölümde Isparta İstiklal Mahkemeleri'nin kurulması, çalışması ve aldığı kararlar, Isparta İstiklal Mahkemeleri'nde görev yapan reis ve üyelerin biyografileri hakkında bilgi verilmiştir. Dördüncü bölümde ise; çalışmanın asıl amacını oluşturan Isparta İstiklal Mahkemeleri'nin Osmanlıca olan dava metinleri günümüz Türkçesi'ne en yakın şekilde çevrilmeye çalışılmıştır.

Although it has been almost 100 years since the Courts of Independence were in operation, the Courts of Independence and the work of these courts are also among the most discussed issues in the history of the Republic of Turkey. One of the main reasons for this debate is that the subject has not been sufficiently explored and clarified. However, this subject is closely related to the fields of history, politics, sociology, law and psychology and requires research in it. Archives of the Parliament and the Prime Minister, ATASE, Nutuk, newspapers and magazines are official sources that can be consulted on this subject. This issue is one of the important issues that should be addressed objectively, since the studies carried out most often take the form of publishing personal memories or statements made by hearsay. In this study; an assessment will be made of the activities of the Courts of Independence in Isparta and nearby areas, which are within the scope of the court's activities. The thesis consists of three main parts. The first part consists of four parts by itself. The first part will deal with the Law of Hıyanet-i Vataniye and its implementation, the second part will deal with the Courts of Independence and the reasons for the establishment of these courts, the third part will deal with cases handled by the Courts of Independence, and the last part will mention the closure of the Courts of Independence. The second part consists of three parts by itself. The first part examined the actions of Isparta's resistance against the Italian occupation and their results, and the second part gave information about Hafız İbrahim Demiralay and his activities, which played a big role in Isparta's contribution to the national struggle. The third part mentioned the support of Demirci Mehmet Efe, one of the commanders of the National Forces, who made a great contribution to the resistance of the Aegean region against enemy occupation, to the resistance of Isparta and its environs. The third part consists of four parts by itself. The establishment, activities and decisions of the Courts of Independence of Isparta, which constitute the main objective of the study in the first three chapters, are the tax returns of the leaders and members working in the Courts of Independence of Isparta. In the fourth chapter; The texts of the Ottoman cases of the courts of Independence of Isparta, which constitute the main goal of the study, have been attempted to translate as closely as possible into modern Turkish.
