Özet
Bu çalışmada hukukçu ve siyasetçilerin“adalet kavrayışlarının”karşılaştırmalı olarak ortaya konması amaçlanmaktadır. Araştırmanın konusu olan; hukuk-siyaset ilişkisinde adalet, hukuku ve siyaseti önceleyen yaklaşımlar çerçevesinde tartışılmaktadır. ilk olarak kavramsal bağlamda -ilişkili olduğu- hak, eşitlik, özgürlük ve ahlak kavramları ile ele alınmaktadır. Ardından araştırma katılımcılarının hukuk ve siyaset anlayışları, hukuk-siyaset ilişkisinin adalete yansımaları incelenmektedir. Araştırmanın amacı doğrultusunda nitel araştırma yöntemleri tercih edilmiştir. Araştırma, siyasi temsil kurumu ve yasama organı olan TBMM 27. Dönem Milletvekilleri ile Yüksek Yargı (Anayasa Mahkemesi, Yargıtay, Danıştay) hakimi olan hukukçulardan oluşan örneklem üzerinde gerçekleştirilmiştir. Veri toplama aşamasında, örneklem olarak belirlenen on altı (16) milletvekili ve on dört (14) hakimden oluşan toplam otuz (30) katılımcı ile derinlemesine mülakat gerçekleştirilmiştir. Elde edilen veriler, nitel veri analiz yöntemleriyle yorumlanmıştır. Araştırmanın temel bulgularında, araştırmanın kapsamı çerçevesinde katılımcı gruplarının adalet kavrayışları ortaya konulmaktadır. Adalet kavramının ağırlıklı olarak hak ve ahlak temelli idealist çerçeveden tanımlandığı söylenebilir.“Olması gereken”adalet, hukukun ve ahlakın öncelendiği bir idealken, realitede“olan”ise siyasetin belirleyiciliğidir. Hukuk kavramı, yasallıktan çok toplumsallıkla ilişkilendirilmektedir. Siyaset kavramı ise her iki grupta da,“yönetmek”ile“topluma hizmet etmek”kategorilerinde eşit bir dağılım göstermektedir. Hukuk-siyaset ilişkisinde ideal bağlamda“kuvvetler ayrılığı ilkesi”vurgulansa da, uygulamada hukuk ve siyasetin yoğun ilişkiselliğinin adalete tesiri farklı perspektiflerden tartışılmaktadır.

This study aims to reveal“the understandings of justice”of jurists and politicians in a comparative manner. The subject of the research, justice in the law-politics relationship is discussed within the framework of approaches that prioritize law and politics. First, it is discussed in a conceptual context with the related notions of right, equality, freedom and morality. Then, the research participants' understanding of law and politics and the reflections of law-politics relationship on justice are analyzed. Qualitative research methods are preferred in accordance with the purpose of the research. The research is carried out on a sample consisting of 27 th term deputies of the Grand National Assembly of Turkey, which is the political representation institution and legislative body, and jurists who are judges of the Supreme Judiciary (Constitutional Court, Court of Cassation, Council of State). In the data collection phase, in-depth interviews were conducted with a total of thirty (30) participants, consisting of sixteen (16) deputies and fourteen (14) judges, who were determined as samples. The obtained data are interpreted with qualitative data analysis methods. Considering the main findings of the research, within the scope of the research, the understanding of justice of the participant groups is exposed. It can be stated that the concept of justice is defined mainly from an idealist framework based on rights and morals.“What should be”is an ideal where justice, law and morality are prioritized but the actual reality is that decisiveness of politics. The concept of law is associated with sociability rather than legality. The legal definitions of the participants are predominantly social. The concept of politics in both groups, on the other hand, displays an equal distribution in the categories of“administrating”and“serving the society”. Although the“separation of powers principle”is emphasized in an ideal context in the law-politics relationship, the influence of the intense relationality of law and politics on justice in practice is debated from different perspectives.
