This dissertation examines how the non-existence of an automatic exclusionary rule in the European Court of Human Rights practice affects applicants' right to a fair trial. As evidence in a criminal process forms the reason for conviction and the procedure as a whole, studying any unlawful means of evidence gathering and its effects on the fairness of the trial is of importance. Current literature on this topic focuses on ECtHR's jurisprudence without considering its unique structure. In addition, the issue of illegally obtained evidence is a complicated problem to handle even without assessing its effect on the fairness of a trial. This work explores ECtHR's jurisprudence by focusing on rationales of exclusion, United States' Exclusionary system and the Court's interpretative ways and jurisprudence by depending on mainly doctrinal analyses together with some comparative analyses of legal scholarship and the Court's case-law. It argues that the non-exclusion of automatic exclusionary rules does not imply direct conclusions on the fairness of the trial. The Court's practice differs according to the violation in the procurement of evidence. It, in some cases, constitutes practice similar to automatic exclusion, while in others apply balancing practice to maintain the fairness of the trial. Although this practice seems convenient, it also creates problems of obscurity and inconsistencies.
