Urban transformation in Sulukule, the first practices under the Code No. 5366 that is handing extensive authorization over to municipalities was the first and most ineffective regeneration project in Istanbul, Turkey. According to the local authorities, the inhabitants would benefit from the outcomes of the project, even without leaving Sulukule that is a historical place and the most important neighbourhood of Roma in Turkey. On the contrary, expropriation, forced eviction and demolishment of their homes carried a group of vulnerable Roma people along by a great wave of deterritorialization to different places outside Istanbul where memories, nostalgia and sorrow melt together. Long lasting processes and heated struggles on many platforms eventually led to many conflicts related with the current debates in sociology of law; like gentrification, identity of minorities, right to the city, housing and property rights of the vulnerable social groups, urban identity and culture. It was not an ordinary regeneration project like those embracing social developments as often witnessed in other parts of the city. It took place through waves of bulldozer renewal on a historical and cultural site, ignoring social and cultural assets. The judicial processes that would be resulted with annulment decisions were not as fast as the constructions in the built-up area or the prompt changes of the plan notes bowing to the construction firm's demands to finish new“villas”adorned with vernacular architectural features. Therefore, the judicial system was not able to prevent the unfortunate consequences such as discrimination, displacement, coerced removal of the urban Roma community, be deprived from the right to adequate housing and finally gentrification, which was not as anticipated. This thesis details the advantages and disadvantages of the urban regeneration practices in Sulukule, in the context of urban sustainability, socio-legal, socioeconomic and politicaljudicial dynamics. The first chapters highlight socio-legal dimension of the community of Roma in the context of gentrification, social stratification and economic impacts, mostly influenced by the violations of minority rights and housing rights, and right to the city. Field surveys indicated that Sulukule is still one of the most problematic areas of the city. In the end, the thesis dwells on the legal dynamics of the Turkish law system with some brief comments in the context of their impacts, deficiencies, ineffectiveness, and finally delays and interruptions in the jurisdiction processes as experienced in this specific case. The thesis also interrogates the latest judicial and socio-legal phenomena after the approval of the annulment decision for this neoliberal project by the Council of State in 2018, declaring that the project did not serve the protection of Roma culture and was not suitable with the public interest.
