Özet
Umut hakkı özü itibariyle insan haklarının alt koludur. Ölüm cezasının hem resmi hem de fiili olarak kaldırılmasıyla birlikte yerine geçebilecek diğer bir seçenek ceza müebbet hapis cezası olmaktadır. Ancak burada da hukukun neyi savunduğunun analizi çok önemlidir. Dolayısıyla hükümlüyü bu yola sürükleyen nedenler ve tetikleyici ortamlarla birlikte suçlu psikolojisini anlama ve bu doğrultuda hukuku yönlendirmek gerekmektedir. Tarihsel boyutta insan haklarına ve umut hakkına nasıl ulaşıldığı, umut hakkı kapsamında hükümlülerin ne gibi hakları olduğu, Avrupa İnsan Hakları Mahkemesinin uygulamalarında bu hakların nasıl korunduğu işlenerek hükümlüde meydana gelen ''hiçbir zaman tahliye olamayacağı'' düşüncesinin nasıl yıkılabileceği bu çalışmanın amacı olacaktır.

The right to hope is essentially a subbranch of human rights. With the abolition of the death penalty both officially and defacto, another alternative punishment that can be substituted is life imprisonment. However, the analysis of what the law advocates is very important here. Therefore, it is necessary to understand the psychology of the criminal along with the reasons to crim and triggering environments that lead the convict to this path so guide the law in this direction. The aim of this study is to examine how human rights and the right to hope have been reached in the historical dimension, what rights convicts have within the scope of the right to hope,how these rights are protected in the practices of the European Court of Human Rights and to seek an answer to the question of how the idea that ''the convict can never be released'' can be destroyed.
