Özet
75 VI.OZET Bu çalışmada, adli nitelikteki ölüm olgularında otopsi kararının yanlış verilmesi ve/veya uygulanan otopside eksiklikler bulunması nedeniyle yargılama aşamasında ortaya çıkan sorunlar ve sonradan yapılan incelemelerle bu sorunların ne derecede çözümlenebildiği araştırılmıştır. Adli Tıp Kurumu 1. ihtisas Kurulu'nun 1999-2000 yıllarına ait 2140 adet raporu incelenmiş; bu raporlar otopsinin yasalarımızda düzenleniş şekli ve otopsinin önemi ve amacı gözönünde tutularak değerlendirilmiştir. Bu değerlendirme yapılırken; yargı organlarınca tespiti istenen hususlar, olguların olayın niteliği ve/veya ölüm şekillerine göre dağılımı, ölü muayenesi ve keşiflerin yapıldığı iller, ölümün meydana geldiği ve/veya ölünün bulunduğu yer, otopsi yapılma oranlan, otopsilerde vücut boşluklarının açılma oranlan, otopsiyi yapan hekimin uzmanlık alam, otopsilerin yapıldığı iller, feth-i kabir yapılma oranlan ve yapılış zamanı, otopsilerde örnek alınma oranlan ve bununla ilgili olarak ortaya çıkan sorunlar, emanete alınması gereken materyalin alınma oranlan, kesin ölüm sebebi sorulan olguların oranlan, otopsi yapılıp yapılmamasının ve feth-i kabir uygulamasının kesin ölüm sebebinin saptanmasındaki rolü, olayla ölüm arasında illiyet bağı bulunup bulunmadığı sorulan olguların oranlan, otopsi yapılıp yapılmamasının ve feth-i kabir uygulamasının illiyet bağı bulunup bulunmadığının saptanmasındaki rolü, ölümde etken ortak sebep olup olmadığı sorulan olguların oranlan, otopsi yapılıp yapılmamasının ve feth-i kabir uygulamasının ölümde etken ortak sebep olup olmadığının saptanmasındaki rolü incelenmiş ve bu konularda ortaya çıkan sorunlarm çözüm yollan tartışılmıştır.

76 VI.SUMMARY In this study, problems in judgement of death cases which are related to the mistakes about the autopsy decision and/or the defects of the performed autopsy are the detected. 2140 reports of the 1. Special Commission of the Institute of Forensic Medicine about the cases in 1999-2000 are examined and these reports are assessed considering the importance and the aim of autopsy. We investigated the following items: 1. Classification of the cases according to manner of death and/or characteristics of incident 2. The cities, in which, crime scene investigations including postmortem inspection of the corpse were carried out 3. The scene of death 4. The ratio of autopsies to postmortem examinations 5. The number of examinations of body cavities during the autopsy 6. The autopsying physician 7. The cities in which the autopsies were performed 8. The number and the time period of exhumation 9. The number of sampling and the problems related to sampling 10. The number of collecting and preserving evidence 1 1. The number of cases in which the cause of death were asked 12. The role of autopsy and exhumation in determining the cause of death 13. The number of cases in which the causal relationship between the incident and death was asked 14. The role of autopsy and exhumation in assessing the causal relationship between the incident and death 15. The number of cases in which the presence or absence of associated causes in death were asked 16. The role of autopsy and exhumation in determining presence or absence of an associated cause in death. We also discussed how these problems could be solved.
