Özet
Bu çalışmanın amacı, 6098 sayılı Türk Borçlar Kanunu'nun 66. Maddesinin 3. fıkrasında düzenlenen adam çalıştıranın organizasyon sorumluluğunun özel hastaneler açısından incelenmesidir. Yeni bir kusursuz sorumluluk olarak kanunda düzenlenen bu sorumluluk uyarınca, bir işletmede adam çalıştıran, işletmenin çalışma düzeninin zararın doğmasını önlemeye elverişli olduğunu ispat etmedikçe, o işletmenin faaliyetleri dolayısıyla sebep olunan zararı gidermekle yükümlüdür. Bu çalışmada; özel hastanelere ilişkin kanuni düzenlemelere göre, özel hastane ve özel hastane işleteni kavramları açıklanmıştır. Özel hastane işleteninin hukuksal sorumluluklarına genel olarak değinilmiş, adam çalıştıranın organizasyon sorumluluğuna ilişkin kanuni düzenleme incelenmiş ve özel hastaneler bakımından organizasyon sorumluluğunun uygulanabilirliği tartışılmıştır. Daha sonra yargı kararları eşliğinde hastane işleteninin organizasyon yükümlülüğünün görünüm şekilleri detaylıca incelenmiştir. Son olarak hastane işleteninin organizasyon sorumluluğunun hüküm ve sonuçları tespit edilmeye çalışılmıştır.

The aim of this study is to examine the organizational responsibility of the employer, which is regulated in the 3rd paragraph of the 66th article of the Turkish Code of Obligations No. 6098, in terms of private hospitals. Pursuant to this responsibility, which is regulated in the law as a new strict liability, the employer is obliged to compensate the damage caused by the activities of that enterprise, unless he proves that the working order of the enterprise is suitable to prevent the damage. In this study; according to the legal regulations regarding private hospitals, the concepts of private hospital and private hospital employer are explained. The legal responsibilities of the private hospital employer are mentioned, the legal regulation regarding the organizational responsibility of the employee is examined and the applicability of the organizational responsibility in terms of private hospitals is discussed. Then, the appearance of the organizational obligations of the hospital employer were examined, accompanied by the judicial decisions. Finally, the provisions and results of the organizational responsibility of the hospital employer were tried to be determined.
