Özet
Her geçen gün kullanım alanı genişleyen ve kullanıcı sayısı artan İnternet, bireyin maddi ve manevi varlığını geliştirmesi ve insan onuruna layık yaşam sürmesi için çok önemli bir rol oynamaktadır. Günümüzde İnternet pek çok insan hakkının yaşama geçirilmesinde etkili bir ortam sunmaktadır. Bu nedenle İnternet'e erişim hakkının tanınması ve düzenlenmesi bir gereklilik olarak karşımıza çıkmaktadır. İnternet'e erişim hakkı en genel şekliyle İnternet'e bağlanabilmek için gerekli olan altyapı ve donanıma ulaşabilmeyi ve de İnternet'te içeriğe erişebilmeyi ifade eder. Çalışmamız içerisinde İnternet'e erişim hakkının unsurları incelenmiş, hakkın kuramsal temellendirmesi yapılmış ve İnternet'e erişimin nasıl bir hak olduğu sorusuna yanıt aranmıştır. Bu değerlendirmeler yapılırken İnternet'e erişim hakkının diğer haklarla olan bağlantılarına yer verilmiş ve hakkın sınırları tespit edilmiştir.

The Internet, which has an ever-expanding area of use and increasing number of users, plays a very important role for individuals to develop their material and spiritual existence and to maintain a life worthy of human dignity. Today the Internet provides an effective environment for the realization of many human rights. Therefore, there is a necessity to recognize and regulate the right to the Internet access. In its most basic form, the right to the Internet access refers to the ability to access the infrastructure and equipment necessary to connect to the Internet, as well as the ability to access to the content on the Internet. In our study, the elements of the right to The Internet access is examined, the theoretical basis of the right is analyzed and an answer is seeked for the question of what kind of a right access to the Internet is. While making these evaluations, the connections of the right to the Internet access with other rights are mentioned and the limits of the right are determined.
