Özet
Teknoloji, sağlamış olduğu imkanlar vasıtasıyla insanları pek çok açıdan etkileyen bir yapıya sahiptir. Sanayi Devrimi itibariyle gelişim gösteren modern teknolojiyle söz konusu etki farklı seviyelere ulaşmış ve günümüz insanının dünya tasavvuru, geçmiştekinden farklılaşmıştır. Küreselleşme olgusu da dünya tasavvurundaki değişimin bir tezahürüdür. Dünya tasavvurundaki değişim; bireyi, dolayısıyla toplumsal yapıyı dönüştürmektedir. Toplumsal durumun bir ifadesi olan örf de doğal olarak bu değişimden etkilenmektedir. Örf, haddi zatında değişken bir yapıya sahip olmakla beraber, teknolojinin söz konusu etkisiyle modern öncesi örfünden farklı bir mahiyete kavuşmuştur. Bu durum ise örf anlayışının değişimini doğurmuştur. Teknolojinin etkisiyle oluşan değişimler silsilesinden Müslümanların da etkilenmesi, bu durumun örfe etki etmesi ve örfün de fıkhın tali kaynaklarından olması nedeniyle söz konusu değişimin tespit edildiği yer de fetvalardır. Bu nedenle çalışmada, günümüz fetva kurullarının kararları incelenerek örf ve örf anlayışındaki değişimin tespit edilmesi amaçlanmıştır. Bu bağlamda öncelikle teknolojinin mahiyeti ve topluma etkisi incelenmiş, daha sonra küreselleşme olgusuyla arasındaki ilişki ele alınmıştır. Teknoloji-küreselleşme ilişkisi belirtildikten sonra fıkıh kaynaklarındaki örf anlayışı incelenmiş, daha sonra küreselleşmenin etkisiyle günümüzdeki örf anlayışındaki değişim teorik çerçevede ortaya konulmuştur. Son olarak söz konusu teorinin uygulamadaki tespiti için günümüz fetva kurullarından AAOIFI (Accounting and Auditing Organization for Islamic Financial Institutions), Mecmau'l-Fıkhi'l-İslâmî ed-Düvelî ve Ürdün Umumi Fetva Dairesi'nin murabahada maliyete eklenebilen masraflar ve hükmî kabz yöntemleriyle ilgili kararları incelenmiştir.

Technology has a structure that affects people in many ways through the opportunities it provides. With modern technology, which has developed since the Industrial Revolution, this effect has reached different levels and the worldview of today's people has become different from that of the past. This change in the worldview is manifested in the phenomenon of globalization. The change in worldview transforms individuals and thus the social structure. Urf, which is an expression of the social situation, is naturally affected by this change. Although urf has a mutable structure per se, it has gained a different nature from the pre-modern custom with the said effect of technology. This situation has led to a change in the understanding of urf. Since Muslims are also affected by the series of changes caused by the impact of technology, and this situation also affects the custom, and the custom is one of the secondary sources of fiqh, the place where this change is detected is the fatawa. For this reason, in this study, it is aimed to determine the change in the understanding of custom and custom by examining the adjudications of modern-day fatwa councils. İn this context, firstly the nature of technology and its effect on society have been examined followed by an analysis of its relationship with the phenomenon of globalization. After that, the understanding of urf in fiqh sources has been examined, then the change in today's understanding of urf with the effect of globalization has been presented in the theoretical framework. Finally, in order to determine the theory in practice, the adjudications of the modern-day fatwa councils, namely AAOIFI (Accounting and Auditing Organization for Islamic Financial Institutions), Majma al-Fiqh al-Islamī al-Duwali and the Jordan General Iftaa' Department, regarding the expenses that can be added to the cost in murabaha and the methods of constructive possession were examined.
