Özet

Fıkhî ahkâmın inşâı, süreç içerisinde, yatay ve dikey ilişkiler neticesi ilâhî irâdeyle beraber sosyal bir varlık olan insan tarafından farklı zaman ve mekân dilimlerinde meydana getirilmiş ve ahkâmda ekol, siyâset, iktisâd gibi beşerî ve içtimâî unsurlar da etkili olmuştur. Bir Müslümanın ibâdet hayatından bireysel ve toplumsal ilişkilerine kadar hayatının her aşamasında yaşamına rehberlik eden fıkıh ilminin verdiği hükümler arasında dînin asılları olan Kur'ân ve Sünnetten gelen ana ilkeler olduğu gibi târihi süreçte bu bilgiler üzerine inşâ edilmiş yorumlar, kültürel öğeler ve toplumun ortak aklının ürünü sonuçlar da vardır. Bu gerekçe ve gerçeklik ekseninde, son tahlilde fıkhî ahkâmın inşâında psiko-sosyal gerçekliğin tek başına olmasa da büyük oranda belirleyici olduğunu; İslâm Hukûkunu, ilâhî irâdeye uygun hükmü bulmak, ideali yakalamak, insan ve toplumun yararını temin etmek için metafizik ve fizik âlemin naklî ve aklî verileri doğrultusunda târihi süreç içerisinde meydana getirilmiş normlar bütünü olarak tanımlamanın daha isâbetli olacağını tespit ettik.

The construction of fiqh rules was created in different time and space periods by human, who is a social being together with divine will, as a result of horizontal and vertical relations, and human and social elements such as school, politics, and economics were also effective in the rules. Among the provisions given by the science of fiqh, which guides a Muslim's life at every stage of his life, from his life of worship to his individual and social relations, there are the main principles coming from the Qur'an and Sunnah, which are the origins of the religion, as well as the interpretations built on this information in the historical process, cultural elements and the results of the collective mind of the society. There is also. In the axis of this justification and reality, in the final analysis, psycho-social reality is largely, if not alone, determinant in the construction of fiqh rules; We have determined that it would be more appropriate to define Islamic Law as a set of norms that were created in the historical process in line with the transmitted and mental data of the metaphysical and physical world in order to find the ruling in accordance with the divine will, to achieve the ideal, and to ensure the benefit of human and society.
