Özet
Riskli Yapının Yıkımı ve Yerine Yeni Bir Yapının İnşa Edilmesini Konu Alan Arsa Payı Karşılığı İnşaat Sözleşmeleri" isimli bu tezde öncelikle riskli yapının tespit ve yıkımına ilişkin genel süreçler incelenmiş; bu kapsamda kent kavramı ve kentsel dönüşüm ile bağlantısı ile kentsel dönüşümün amacı, yöntemleri ve önemi ile riskli yapı tespitine konu edilen yapıların niteliği, riskli yapının riskli alan ile ilişkisi, mevzuattaki gelişmeler çerçevesinde riskli yapının tespiti için başvuru ve tespit usulü ile itiraz hakları değerlendirilmiştir. Sonrasında, arsa payı karşılığı inşaat sözleşmelerinin genel yapısı incelenerek yıkım süreci doğrultusunda tarafların hak ve borçları, uygulamadaki durumlar ve diğer temel konular ele alınmıştır. Konunun tüm yönleriyle anlaşılabilmesi ve uygulama ile doktrinin de karşılaştırılabilmesi açısından, çalışmada çok sayıda Yargıtay ve Danıştay içtihadı ile Anayasa Mahkemesi'nin görüş ve değerlendirmelerine yer verilmiş; ayrıca tartışmalı olan noktalarda doktrindeki görüşlere değinilerek iştirak ettiğimiz görüşler belirtilmiştir. Sonuç bölümünde ise çalışmadan elde edilen bulgular özetlenmiştir.

In this thesis titled“Construction Contracts for a Share of Land Related to the Demolition of a Risky Structure and the Construction of a New Structure in Its Place”, first of all, the general processes related to the identification and demolition of risky structure were examined; in this context, the concept of the city and its connection with urban transformation, the purpose, methods and importance of urban transformation, as well as the nature of structures, the relationship between a risky structure and a risky area, the application procedure for the detection of a risky structure within the framework of developments in legislation, and the legal rights for these processes, and concerned with the detection procedure has been evaluated. Afterwards, the general structure of the construction contracts in exchange for the land share was examined and the rights and obligations of the parties, the situations in practice and other basic issues were discussed in line with the demolition/deconstruction process. In order to understand all aspects of the subject and to compare the practice and doctrine, numerous opinions and evaluations of the Supreme Court and the Council of the State have been included in the study; in addition, the opinions of the Constitutional Court have been stated by referring to the opinions in the doctrine on controversial points. In the conclusion section, the findings obtained from the study are summarized.
