Özet
One of the most preferred ways of resolving the disputes from Turkey and Korea's commercial relations is arbitration. The recognition and enforcement of foreign commercial arbitral awards attract considerable attention with the increasing usage of international arbitration between the countries. Considering the arbitration-friendliness of the countries provides convenience when effective recognition or enforcement of arbitral awards desired. The focus of this study is the recognition and enforcement of foreign commercial arbitral awards according to Turkish law while comparing it with similar practices in Korean law by means of the literature review method. The 1958 New York Convention provides a unified and simplified procedure for recognition and enforcement. Both Korea and Turkey apply the 1958 New York Convention for most of the foreign commercial arbitral awards. However, there are differences when it comes to iii practice. Turkish courts tend to have less arbitration-friendly interpretations when public policy is in question. On the same issue, it is expected from a Korean court to have narrow interpretations on the public policy and enforce the awards in a friendlier manner. At the end of this study, Turkey and Korea are found to be applying the 1958 New York Convention in compliance with the international standards. Even so, parties should conclude the arbitration agreement with due diligence in accordance with the legal practices and arbitration-friendliness of the country where recognition or enforcement is desired. When recognition or enforcement of the rendered awards requested in Turkey, parties should be aware of the public policy tendencies. Korea's positive attitude towards the recognition and enforcement of arbitral awards on the public policy basis may be a good model to be incentivized by Turkish courts.
