Özet
Fıkıh usûlünün yakından ilgili olduğu alanların başında dil ilimleri gelmektedir. Dil ilimleri çeşitli kategorileri bünyesinde barındıran geniş yelpazeye sahip bir disiplindir. Bu kategorilerden birisini vaz' konuları oluşturmaktadır. En genel anlamıyla lafızların mânaya tayinini ifade eden vaz', usûlcülerin önem verdiği meseleler arasında yer almaktadır. Ancak usûlcüler, vaz' konusunu, sadece vaz' ilminin verilerini temel alarak incelememektedir. Nitekim usûl eserlerinde vaz' meselesi müstakil bir konu olarak ele alınmamaktadır. Bununla birlikte bu verileri, fıkıh usûlünün amacına uygun verilerle değerlendirmektedir. Bir başka ifadeyle vaz', üzerine inşanın devam ettiği bir süreç olarak değerlendirilebilir. Lafızlar bahsinde de bu sürecin işleyişi gözler önüne serilmektedir. Vaz' tartışmalarında farklı görüşler ortaya çıkmıştır. Bunların arka planında kelâm, dil ve mantık gibi ilimlerde ortaya çıkan ekollerin etkili olduğunu söylemek mümkündür. Bir başka ifadeyle vaz' meselesinde ekollerin benimsediği görüşler, hüküm istinbat sürecini etkilemektedir. Ancak bu süreçte etkili olan unsurlar sadece vaz' tartışmaları ile sınırlı değildir. Buna bağlı olarak isti'mâl/kullanım unsurunun fıkıh usûlü açısından merkezi bir konuma sahip olduğunu ifade etmek mümkündür. İsti'mâlin vaz' ile ortaya çıkan bir süreç olduğu dikkate alındığında vaz' ve isti'mâlin birbirini tamamlayan iki süreç olarak nitelendirilmesi mümkündür. Nitekim usûl eserlerinden hareketle isti'mâlin, genel anlamıyla vaz' kapsamında olduğu anlaşılmaktadır. Bu da iki unsuru, birbirinin tamamlayıcısı olarak ifade etmeye imkân tanımaktadır. Vaz' ve onun tamamlayıcısı olan isti'mâl unsurlarına bağlı olarak bu çalışmada daha ziyade“âm, has, müşterek”ve“hakikat, mecaz”ile ilgili meseleler genellikle vaz' cihetinden incelenmektedir. Böylece vaz' olgusunun fıkıh usûlü açısından nerede konumlandığı, hükümlere etki edip etmediği meselesi ortaya konulmaktadır. Elde edilen neticelerden en önemlisi, vaz' olgusunun fıkıh usûlü açısından hükümlerin temelini oluşturan önemli bir unsur olmasıdır. Ancak bu, hükümlerin her birinin muhakkak vaz'î bir dayanağının olması gerektiği anlamında değildir. Tamamen vaz' unsuruna dayandırılan hükümler bulunmakla birlikte isti'mâl unsurunun daha etkin bir rolünün olduğu söylenebilir.

One of the most essential related fields of fiqh methodology is linguistic sciences. Linguistic sciences are a wide-ranging discipline that includes various categories. One of these categories is the science of waḍ'. In the most general sense, waḍʿ, which refers to the attribution of words to meanings, is one of the issues that scholars of ʾuṣūl al-fiqh consider as significant. However, they do not analyze the issue of waḍʿ only on the basis of the data of the science of waḍʿ. As a matter of fact, the waḍʿ is not accepted as a separate topic in the works of ʾuṣūl. However, they evaluate this data together with the data appropriate to the purpose of the ʾuṣūl al-fiqh. In other words, waḍʿ is considered as a process on which construction continues. The functioning of this process is also revealed in the chapter on lexical items. Different views have emerged in the discussions on waḍʿ. It is possible to say that the schools that emerged in sciences such as theology, language and logic were influential in the background of these debates. In other words, the views adopted by the schools of thought on the issue of waḍʿ affect the process of deduction of judgment. However, the influential factors in this process are not limited to discussions on waḍʿ. Accordingly, it is possible to state that the element of istiʿmāl/utilization has a central position in the ʾuṣūl al-fiqh. Considering that istiʿmāl is a process that emerges with waḍʿ, it is possible to characterize waḍʿ and istiʿmāl as two complementary processes. As a matter of fact, based on the works of ʾuṣūl, it is understood that istiʿmāl is within the scope of waḍʿ in general. This makes it possible to express the two elements as complementary to each other. Depending on the elements of waḍʿ and its complement, istiʿmāl, this study mostly examines the issues related to“aam, khas, homonym”and“haqiqa and metaphor”from the aspect of waḍʿ. Thus, the issue of where the phenomenon of waḍʿ is placed in terms of the ʾuṣūl al-fiqh and whether it affects the rulings is revealed. The most important conclusion is that waḍʿ is one of the important elements that constitute the basis of rulings in terms of ʾuṣūl al-fiqh. However, this does not mean that every ruling must necessarily have a waḍʿ basis. Although there are rulings that are based entirely on waḍʿ, it can be said that the element of ʾistiʿmāl plays a more active role.
