Özet
Suç mağdurlarının korunmasına yönelik çalışmalar ve bu alandaki düzenlemeler pek çok ülkede son yıllarda hız kazanmıştır ve mağdur hakları hızla gelişmekte olan bir alan olarak görülmektedir. Suç mağdurunun çocuk olduğu durumlarda ise koruma ve destek hizmetlerinin kapsamlı düzenlenmesi ve etkin uygulanması daha da önem arz etmektedir. Suç mağduru çocuğun ve haklarının korunması söz konusu olduğunda yetişkinlerden farklı önlem ve düzenlemelere ihtiyaç duyulduğu kabul edilmektedir. Çalışma kapsamında Türk ve Alman hukuku çerçevesinde suç mağduru çocuğun korunmasına yönelik düzenlemeler ve suç mağduru çocuğun sahip olduğu haklar iki ülke mevzuatı doğrultusunda karşılaştırmalı biçimde ele alınmıştır. Çalışma üç bölümden oluşmaktadır. İlk bölümde Türk ve Alman hukuku çerçevesinde mağdur, çocuk, suç mağduru çocuk kavramları açıklanmış, iki ülkenin suç mağduru çocuk ile ilgili istatistiklerine yer verilmiştir. Bu bölümde ayrıca suç mağduru çocuğu korumaya yönelik uluslararası belgeler ve düzenlemeler ile Avrupa İnsan Hakları Mahkemesi Kararları da yer almıştır. İkinci bölümde ise Türk ve Alman ceza muhakemesi hukuku çerçevesinde mağdur çocuğun konumu, hakları, korunmasına yönelik özel düzenlemeler açıklanmıştır. Ayrıca bölümün sonunda iki ülkenin düzenlemeleri arasındaki benzerlik ve farklılıklar incelenmiştir. Üçüncü ve son bölümde ise iki ülkenin ceza muhakemesi mevzuatları dışında kalan ve suç mağduru çocuğu korumayı amaçlayan başta medeni hukuk olmak üzere diğer düzenlemelerine ve Gençlik Koruma Kanunu gibi özel kanunlara yer verilmiştir. Bu bölüm sonunda da yine iki ülke hukukunun düzenlemelerini karşılaştırılmış ayrıca genel sonuç ve değerlendirmeler kısmı da yine bu bölümde yer almıştır.

Studies on the protection of crime victims and regulations in this field have accelerated in many countries in recent years, and victims' rights are seen as a rapidly developing area. In cases where the crime victim is a child, comprehensive regulation and effective implementation of protection and support services is even more important. It is accepted that different measures and regulations are needed than adults when it comes to protecting the rights of child victims of crime. Within the scope of the study, the regulations for the protection of child victims of crime within the framework of Turkish and German law and the rights of child victims of crime are discussed comparatively in line with the legislation of the two countries. The study consists of three parts. In the first part, the concepts of victim, child, and child victim of crime are explained within the framework of Turkish and German law, and the statistics of the two countries regarding child crime victims are included. This section also includes international documents and regulations to protect child victims of crime and the Decisions of the European Court of Human Rights. In the second part, the position, rights and special regulations for the protection of the victim child within the framework of Turkish and German criminal procedure law are explained. Additionally, at the end of the chapter, the similarities and differences between the regulations of the two countries are examined. In the third and last section, other regulations, especially civil law, and special laws such as the Youth Protection Law, which are outside the criminal procedure legislation of the two countries and aim to protect child victims of crime, are included. At the end of this section, the regulations of the two countries' laws are compared and the general conclusions and evaluations are also included in this section.
