Özet
Terör, devletler ve toplumlar için büyük bir tehlike arz etmektedir. Bu nedenle her devlet terörü, çeşitli biçimlerde suç olarak tanımlamış ve terörün, halk arasında benimsenmesinin önüne geçmek istemiştir. Terör örgütünün propagandası da terörün desteklenmesi ve yayılmasına sebebiyet verecektir. Bu nedenle 3713 sayılı Terörle Mücadele Kanunu'nun 7/2-5. maddeleriyle terör örgütünün propagandasını yapmak suç olarak tanımlanmıştır. Ancak teröre ilişkin her düşünce açıklaması, bu suçu oluşturmaz. Bu nedenle ifade özgürlüğü kapsamında kalan ve suç teşkil eden açıklamalar arasındaki farkın net şekilde ortaya konulmuş olması gerekir. Bu çalışma, dört bölümden oluşmaktadır. Birinci bölümde terör örgütünün propagandası suçunun maddi unsurlarını oluşturan terör, propaganda ve terör örgütü kavramları tanımlanmıştır. İkinci bölümde terör örgütünün propagandası suçunun Türk ceza hukukundaki görünümleriyle mevcut düzenlemenin konusu, faili ve mağduru incelenmiştir. Üçüncü bölümde terör örgütünün propagandası suçunun unsurları, bu suça etki eden nedenler ve suçun ortaya çıkış biçimleri yargı kararlarıyla ortaya konulmuştur. Dördüncü bölümdeyse hukuka uygunluk nedeni teşkil eden ifade özgürlüğünün kullanımı incelenmiştir. İfade özgürlüğü ve bu özgürlüğün sınırlandırılması örneklerle açıklanmıştır. Son olarak Türkiye'de terör örgütünün propagandası suçu ve ifade özgürlüğünün ilişkisi incelenmiş; teori ve uygulama arasındaki farklara dikkat çekilmiştir.

Terrorism poses a great danger to states and societies. For this reason, every state has defined terrorism as a crime in various forms and has tried to prevent the adoption of terrorism among the public. The propaganda of a terrorist organization will also lead to the support and spread of terrorism. For this reason, making propaganda of a terrorist organization is defined as a crime under Articles 7/2-5 of the Anti-Terror Law No. 3713. However, not every expression of thought related to terrorism constitutes this offense. Therefore, the difference between statements that fall within the scope of freedom of expression and those that constitute a crime should be clearly defined. This study consists of four parts. In the first part, the concepts of terrorism, propaganda and terrorist organization, which constitute the material elements of the crime of propaganda of a terrorist organization, are defined. In the second part, the subject, perpetrator and victim of the crime of propaganda of a terrorist organization in the Turkish criminal law and the current regulation are examined. In the third part, the elements of the crime of propaganda of a terrorist organization, the reasons affecting this crime and the emergence forms of the crime are revealed through judicial decisions. In the fourth part, the use of freedom of expression, which constitutes a reason for compliance with the law, is analyzed. Freedom of expression and the limitation of this freedom are explained with examples. Finally, the relationship between the crime of propaganda of a terrorist organization and freedom of expression in Turkey is examined and the differences between theory and practice are pointed out.
