Özet
Anayasalar, iktidarı sınırlandıran, temel hak ve özgürlükleri güvence altına alan metinlerdir. Bir Anayasanın ilk defa yapılması kadar, anayasa metninin değiştirilmesi de büyük önem taşımaktadır. Anayasayı yapma ve değiştirme gücüne kurucu iktidar denmektedir. Kurucu iktidar da anayasayı en baştan yapan asli kurucu iktidar ve mevcut anayasayı belli kurallar çerçevesinde değiştiren türev kurucu iktidar olmak üzere ikiye ayrılırlar. Bu çalışmada Osmanlı ve Türk Anayasal Tarihinde Kurucu İktidarlar incelenerek anayasa yapım sürecine ilişkin yöntemler ve tartışmalara yer verilmiştir. Sürekli gündemde olan Anayasa değişikliği konusu kurucu iktidarlar bağlamında ele alınarak asli kurucu iktidarın anayasayı en baştan yapma durumu ile biçimsel ve içeriksel sınırları çizilmiş olan türev kurucu iktidarın yetki sınırını ve bu sınırların kapsamını detaylı bir biçimde ortaya çıkarmak amaçlanmıştır.

Constitutions are texts that limit power and guarantee fundamental rights and freedoms. Amending the text of a constitution is as important as making it for the first time. The power to make and amend the constitution is called the constituent power. The constituent power is divided into two as the original constituent power that makes the constitution from the beginning and the derivative constituent power that amends the existing constitution within the framework of certain rules. In this study, Constituent Powers in the Ottoman and Turkish Constitutional History are analyzed and the methods and discussions regarding the constitution-making process are included. The subject of constitutional amendment, which is constantly on the agenda, is discussed in the context of constituent powers, and it is aimed to reveal in detail the limit of authority of the original constituent power to make the constitution from the beginning and the limit of authority of the derivative constituent power, whose formal and contextual limits are drawn, and the scope of these limits.
