Özet
Araştırmanın amacı Anayasa Mahkemesi Kararlarının incelenerek bütçe hakkına ilişkin Mahkeme tarafından koyulan kuralları tespit etmek ve kurallara göre bütçe kanunları ve diğer normların nasıl değerlendirdiğini veya değerlendireceğini belirlemektedir. Bu çalışma yürütülürken muhakkak kendi fikirlerimize de yer verilmiş olmakla birlikte Kararlardan çıkarılamayacak bir sonuca ulaşmamak çalışmamızın sınırları teşkil etmektedir. Çalışma yürütülürken Anayasa Mahkemesinin Merkezi Yönetim Bütçelerine ilişkin bütün kararları, diğer normlardan ise bütçe hakkıyla bağlantı olanları incelenmeye çalışılacaktır. Çalışmanın bir kısmında literatürde çok inceleme fırsatı bulunamayan 16.4.2017 tarihli Anayasa değişikliğinden sonra bütçe hakkının kullanımda bir sınırlama veya değişiklik getirip getirmediği incelenecektir. Bu inceleme Anayasa Mahkemesinin Cumhurbaşkanlığı Kararnameleri üzerinden yaptığı denetimler incelenerek yapılacaktır. Sonuç olarak Anayasa değişikliği öncesi ve sonrası bütçe hakkına ilişkin Anayasa Mahkemesinin koyduğu kurallara ulaşmak çalışmanın odak noktasının oluşturacaktır.

The aim of the research is to examine the Constitutional Court Decisions and to determine the rules regarding the budget right and to determine how it evaluates or will evaluate budget laws and other norms according to the rules. Although our own ideas were certainly included while carrying out this study, not reaching a conclusion that cannot be drawn from the decisions constitutes the limits of our study. While carrying out the study, all decisions of the Constitutional Court regarding the Central Government Budgets and other norms related to the budget right will be examined. In one part of the study, whether there was a limitation or change in the use of the budget right after the Constitutional amendment dated 16.4.2017, which could not be examined much in the literature, was investigated. This review will be carried out by examining the inspections carried out by the Constitutional Court over the Presidential Decrees. As a result, the focus of the study will be to reach the rules set by the Constitutional Court regarding the budget right before and after the Constitutional amendment.
